Redundancy question

I'm facing redundancy and in a fairly large pool. I anticipate I will be at or near the top of the scoring, with other people therefore selected for redundancy.

However we've been told we will now be working evenings and weekends on a rota, whereas at the moment I work set week days. I can't do this for childcare reasons.

I will be having an individual consultation meeting soon but I just wondered what happens if I score highly but then can't do the changed days? Do they have to make me redundant? Do I have to put my hand up for it? I'm a bit confused about it all!

If you are in a large pool it could be that you are being considered for a different job, or that it’s the same job but with different hours.
The job offered to you has to be ‘suitable alternative employment’. It is you that indicates whether it’s suitable. If they are substantially changing your hours then it sounds like it isn’t. Hopefully you are in a union and they can help.
If the job isn’t suitable they can look to redeploy you into a different role or you could be made redundant.

They do not have to make you redundant if you refuse to do the changed days, but they could select you for redundancy if you tell them during the consultation that you will not be able to change your days.

Whether they can change your days without your consent depends on what it says in your contract. If your contract is for set days and there is no flexibility clause, they need your consent. If you refuse to consent, they can either force the change or dismiss you. If they force the change and you continue working, you will be viewed as having accepted the change. If you stop working, you may have a case for constructive dismissal. If they dismiss you, you may have a case for unfair dismissal.

Thank you SO much, that is really helpful. The nature of my job is not set hours but when I had my child I applied for flexible working and my contract was amended to work three set days. The rest of the pool of workers are full time and more flexible, I'm the anomaly. They are saying want to retain three full time positions.

They cannot select you for redundancy on the basis that you are part time and they only want full time staff. Many businesses get this wrong.

@prh47bridgeindirectky that kind of happened to me as I was assessed at the top of the redundancy score because i performed badly as I wasn’t basically doing work when I wasn’t in and so couldn’t be relied upon. I was given the job after maternity leave knowing I was only working 3 days a week. I appealed and won a better settlement as it was grossly unfair.
