When should we pursue legal action?

So my husband has been off sick for several months after unacceptable conduct by his employer. He’s been diagnosed by the NHS as having an adjustment disorder directly linked to their conduct. The company is insisting on a disciplinary hearing regarding a matter linked to his absence. He is unlikely to return to his job because of their conduct but mainly because he is very unwell. We are intending to bring a personal injury claim against his employer as a result of their conduct and the psychiatric injury they’ve caused and the resultant impact on him. I have experience in this area so am comfortable we have a claim. What I don’t know is at what point to notify his employer. Should we start now before the disciplinary hearing or wait until after it?

Not my area of expertise but perhaps post this in legal as well to get a better chance of advice. I hope your DH recovers and you get what you want from this

There would be a slightly higher threshold for a work related injury (in terms of the length of absence an employer is required to accept before terminating) so logically it might make sense to issue a claim before any disciplinary to preserve that slightly higher threshold…

They are notoriously difficult claims to succeed in though.
