Grievance against me not upheld, next steps?

Earlier this year I posted on here that a colleague had raised a formal grievance against me for harassment. Serious claims, full investigation. A couple of weeks ago I received a copy of the investigation report, to discover that I had been found "guilty" on all claims made, but the report made clear that while I had had an investigation meeting I had not been provided with any of the actual evidence the claimant had provided, nor any additional witness statements, which is contrary to acas guidance and the internal procedure.

I sought legal advice since I could only assume I would face disciplinary proceedings and need to launch my own grievance against them for how badly this has all been done.

Monday I was invited to a meeting with HR ( I work for a large organization), at which point they stated they themselves had serious concerns with the investigation and are overturning all the findings and I have no case to answer.

I'm relieved but I have been an emotional mess for months during this process, and paid hundreds in legal fees. Im currently on leave, but have lost trust and confidence in my employer and face having to work with the person who still probably believes I'm discriminatory.

HR have suggested mediation and are open to ideas I may have to move forward or next steps.

I don't know whether to request a settlement agreement and leave, agree to mediation but ask for some compensation and try and stay.

Not sure what to do.

I'd say settlement agreement and leave. They sound absolutely shit.

How likely are you to get another job? I would focus on what is going to be the best longer term outcome for you and work the rest out around that.

It depends on a number of variables.

How long could you afford to be without work? Work is difficult at the moment, and jobs are fewer with a lot of competition.

Today's news is tomorrow's chip wrappings, so don't let your perception of how you were treated influence the reality. They may be the same, but they may not be.

Do you have an option to work un a different area for a different line manager?

It sounds like, ultimately, you haven't done anything wrong, so why should you be pushed out?

Do you like working there otherwise?

How long have you been there?

If this hadn't happened, would you have stayed, or left eventually anyway?

Are HR taking any action against the perpetrators of the poor process?

I'm sure I'll think of more, but don't cut off your nose to spite your face.

The issue is - they don’t have to do anything, they’ve already wasted tonnes of HR / management time on this, the last thing they’ll want to do is give you a settlement, or payment, why should they? Due to hurt feelings? Harsh at it sounds, I think it’s doubtful.
You need to put this behind you now and either find a new job or get your head down with this one.

If you have lost all confidence in your employer then you would be best off getting as big a settlement as you can plus ensure your reference is to your satisfaction and then leave, as long as you are confident that you can find another job.

If you love your job and feel you don’t want to be forced out you could stay but I think it would be very stressful working in a place where someone was gunning for you. Plus you didn’t see the witness statements so you don’t know who said what so who knows who you can trust.

It sounds awful and I think you will be best off out of it.

Maybe speak to ACAS? https://www.acas.org.uk/advice I'd be tempted to raise my own grievance about the way it was handled. Do you think the person who raised the grievance against you was harassing, and will continue to harass you?

Take the money and run.
