I want to leave in my probationary period, can anyone understand my contract?

Hi everyone,

Long story I want to leave my job, the contract isn’t clear how much notice I have to give?

It’s an awful work place and ideally I’d like to leave immediately. But the wording isn’t clear!

I want to leave in my probationary period, can anyone understand my contract?

The way I’m reading this is that even though they can give you a months notice for termination your probation period, you will have to give 3 months notice to leave. Even during your notice period. How bloody cheeky.

I would argue if you're in your probation period, the notice they give you needs to be the same you give them. I'd write "a month's notice as per the contract" in my notice letter and submit.

Cheeky bastards! They only have to give you a month but you have to give three. What are the penalties/consequences if you go after a month?

What can they do if you don’t go back? 3 months is steep unless long term or v senior.

They can't force you though. Just give them 1 month notice. They are not going to suffer a financial loss by you leaving early, not if you're new.

DH had this recently and argued that as it was the probationary period the same notice period applied both ways as it wasn’t otherwise stated.

They weren’t happy about it but did let him go.

Ooops sorry - read it again, THEY can terminate with one months notice during your probation period but YOUR notice period remains three months. I’d be surprised if they didn’t let you go earlier.

I threatened to leave last week and got talked out of it, when I asked HR how do I go about leaving she said I had to give 1 week! So I’m just going to quote what she said and hope for the best 😬

If you hate it screw the notice period and leave with immediate effect or resign giving the notice period then go sick citing MH issues die to work related stress.

On the plus as it is you should be paid for your entire notice period.

I’ve done a 3 month notice period before. Worst 12 weeks of my life!!!! I’d give a months notice. What are they going to do about it?

I absolutely don’t want to do a full three months. But my employer is dreadful and unprofessional, so who knows what they will do. I’m mindful I want to be professional and get a reference. But they will work me to to bone to get it 😭

How long have you worked there? I would be inclined to give a weeks notice and remove the organisation from your CV.

do you want three months paid gardening leave? If so say that you are going to the competition? Sit back and get paid?

if you want to exit asap then say that as you are in your probation you will be happy to accept a short term notice. I got away with two weeks once

Hmmm interesting. I hadn’t thought about that! How will they check if I do actually go to the competition, I’m sure there is clause somewhere in my contract saying I can’t within a certain time frame.

Hand in your notice then get signed off with work related stress for the notice period

But when a future employer asks then I will have to disclose I was signed off sick. Not sure I want that on my record 😬 Think I’d like to come away with my reputation in tact if possible.
