Annual leave during resignation

My annual leave entitlement is 28 days from Jan 1st till end of year. The bank holidays are given on top of this.

If my last contracted day is 30th April, how many days annual leave do I have to take? I gave notice on Feb 1st.

I work it out to be 10 days but want to double check?

Ask HR as formulas may vary.

Also, if you don't take the leave, most employers will pay you for the leave not taken (at least in the UK)

I would calculate it as (4 months / 12 months) x 28 days and come up with 9.3 days of annual leave.

Bank Holidays are separate. I think technically your employer could use the same calculation above but with 8 days instead of 28 days to calculate your “part year” entitlement to Bank Holidays (essentially by leaving mid year, you’re working part time this year for them!). In reality, I suspect most employers won’t calculate Bank Holiday entitlement in the way on leaving and you will just have had the days you’ve had. I think they could apply the calculation though, and take any excess off your annual leave entitlement.
