Another part time holiday allowance question

I'm sure these threads have been done so many times but I'm at a loss.

DH works 4 days per week PT. FT would be 5 days. He does Mon -Thurs. Work closes on BHs.

His employers have recently changed his (and other workers) contracts to have shut down over Xmas. This year that means 24th-1st. He must take 4 days leave which due to BHs means he will have used a full week of leave, FT employees will also only have to use 4 days so 20% less leave overall. One BH falls on his non working day anyway.

I've asked him to double check what full time employees get and their contracted hours to check what he works is 80%.

(For context we both work PT (4 days, my leave is much easier) and share childcare. Have family to help in school holidays but do like to prioritise family holidays. The changes to his leave have left us short this year, by the time BH and the Xmas days are taken he seems to have very little left to take as he wants to).

If anyone can help I would be grateful.

If he has 20 days plus bank hols full time he will have 16 days on a 4 day week plus bank hols. 24th to 1st would remove 4 days from that, the bank hols are separate

So for a FT worker, there are 3 BHs and 4 AL days required to take the shutdown period off.

For your DH, one BH falls on a non working day, so he should take 6 days leave to cover it, when a FT worker needs 7.

So I’m not sure where the 4 comes from. What they should do is give him 22.4 leave days total and deduct the banks that fall on a working day (6) leaving 16.4 to take. Then deduct 4 for the days he would usually work over Christmas, leaving 12.4 left to take for the year?

But they can’t ask him to take 4 leave days plus 3 banks - it’s 4 leave days plus 2 banks.

Thanks. Sorry I'm confusing myself now!
So regarding BH, should he get anything pro rata on his allowance for these or is it a case of as they fall on a working day he must take a full day from the allowance each time.

I thought he'd have to take 80% of the day so each time 20% of a day would go back to his overall allowance.

(I'm a nurse so have never had to deal with this!)

He is entitled to 80% of the annual bank holidays - so total 6.4 days as base. Then if his non-working day falls on any bank holidays in a year he gets a credit for that day added back on.

His total leave for a year is then that figure plus 80% of the FTE annual leave allowance.

It can vary from year to year depending on what his non working day js and what days Christmas, Boxing Day and New Year's Day fall on, some years will work out better than others.

If all bank holidays fall on days he should otherwise have worked then he will need to use part of his normal holiday allowance to cover it and make up the shortfall. That is how it works - and why a lot of 4 day week people take Mondays as their non working day as it's less of a hit.

4 days leave is correct for the Christmas shutdown for this year. He needs to "give" 1.6 days bank holidays worth from his usual allowance though over the year but Boxing Day falling on the Friday will credit 1 day for him so this is a year where it works in his favour overall

Could he do a different 4 day week that doesn't include Mondays?

If they give standard 28 days for full time then he's entitled to â…˜ of that which is 22.4 days. He needs to deduct any bank holidays and shut downs to leave the days he can choose for himself.

No, he will have 16 days plus 4/5 of bank holidays.
You don't need to take AL for days you don't work.
I also work M-Th and work for an employer with a Christmas closure.
I take 4 days AL to get a full week off.

This year if our Christmas closure is the same as your DH I'll take:
AL 24th and 25th.
26th day off.
Weekend.
AL 29-1st. I won't go in on the 2nd as it's my day off.
So I'll get 8 days off work with 6 days AL.

FT employees 9_5 are still using some of their annual leave as BH just automatically taken and not calculated/added onto leave calculation. If part time or work compressed hours, you have to take the number of hours normally worked on the bank holiday as leave, so if on compressed hours, it could be a 9 hour day and others could be 6 hours. If employer is flexible, you could see if on weeks during the year with bank holidays in they switch and work a friday then don't need to take leave for the Monday (which works if you have cover from family etc), then you still have the family day and can use the saved leave at another time.
