Holiday Entitlement

Hi, my daughter works part-time at a well known garden centre chain. Her contract hours are 4 per week, but since joining she has worked 3 days a week (22 hours). Her annual holiday entitlement is 24 hours, which seems correct for 4 hours per week.

Should her entitlement be based on 22 hours per week?

When she does receive holiday pay it is higher than her base (minimum wage) rate, so calculated from her average earnings I presume.

I'm just unsure if her holiday entitlement is correct?

Her holiday will be based on her contracted hours. I don't think it's usual to get holiday based on overtime.

Thanks, just doesn't seem very fair when she's rota'd for 22 hours every week.

Her annual holiday entitlement is 5.6 weeks (that's the minimum statutory). The contract is a bit of a red herring - maybe she can ask for her holiday to be put in weeks rather than hours.
She books a week's holiday and they will look back 52 working weeks to ascertain what her average pay is and pay her accordingly.
.gov site is the place to look for a very full explanation.

Legally she's definitely entitled to holiday pay to cover regular overtime, but yes normally that's reflected in extra, pro-rated pay, not extra allocated hours.

The flip side is she should be able to book a weeks holiday with 4 hours of 'leave' - it may be the case she needs to mention that to management when booking though!
