Term Time Only - Pay Still Owed

Hi, can I have some advice on Term Time Only contracts please.

I worked for one term as a Midday Supervisor up until the last day before the Christmas break. I was paid for the whole of December, so the school believes they have actually overpaid me. But given that my 38 week salary was spread out over 12 months, thus I got less each month than I actually earned, I believe they still owe me. They just keep saying they don't. Am I wrong? The maths seems pretty simple:

Annual Salary: £3,946 (paid over 12 months)
Weeks Worked Per Year: 38 weeks
Days Worked Per Year: 38 weeks × 5 days = 190 days
Daily Rate: £3,946 ÷ 190 days = £20.77 per day
Earnings for 71 Days: 71 × £20.77 = £1,474.67

No, I started on 2 September so I worked the whole term - I was physically in the school for 71 days that term

But you had half term off and some of the Christmas break. Just ask them for the calculation

What date did you break up? Does the school have a one week or a two week half term?

But I don't understand why they are correct. The money they have paid me works out at 63 days, I worked 71?

We're you given an hourly rate? Or just an annual salary?

You probably had more weeks off in proportion to the amount of time you worked. You aren't paid for the holidays but your wage is split into 12 monthly instalments. If you don't work the whole school year then that will affect money paid to you.

But your December pay was the same as October and November. Regardless of the last working day your end of contract is probably 31st Dec so you have been paid until the end of the month.

For this type of contract, your final holiday accrual should be quite high, to account for the fact you haven’t had the long summer holiday.

Did you get holiday pay in your final pay?

£3946 could be an annual salary for 52 weeks and paid pro rata

Which is £15.17 per hour

does that rate include annual leave at 12%?

I didn't have more weeks off than I accrued. I had one week at half term. But each of the 4 monthly payments I received were artificially low because the 9 month salary was smoothed out over 12 months. Is anyone able to show me where have I gone wrong in my calculations?

I think your annual salary includes 190(5) woking days and usually 20 holiday days so its actually 210(15 depending on training days arrangements) to divide the total salary by.

All schools, I predict, work out pay the way your school have. This will have been agreed with the main trade unions.
