Holiday calculation

OneSparklyGoldBear · 04/02/2025 14:41

I have a 13 week notice. My holiday entitlement runs from Jan 1st to December 31st. It is 28 days but I carried over 2 days from last year into this year so 30 in total. 2 days have to be used up by start of March. I get bank holidays on top.

The contracted hours are 37.5hours per week with no weekend working.

If I was to resign tommorow, what date is my final date at my workplace and how many holidays do I have to take?

13 weeks notice, your last day will be Tuesday 6 May.

We only accrue holidays for whole months, so you'll get 4 months (Jan-April)

We round up or down too, so yours works out at 9.33 (rounded down to 9 days).

Obviously don't know what your employer does, but that's what would happen at our place.

Notice takes you up to 7th may. So you'd have just over 4 months holiday so 9 or 10 days. (1/3 of 28) Plus the other 2 days you've carried over.

You'll also be due a third of the bank holidays or just over. But as there will be Easter and may bH and new year you may be off on too many by the time you leave so could have to pay some back.

I think the gov.uk website will have a calculator

Last working day Tuesday 6th May.

Are BH included in the 28 days or in addition?

If included you accrue 0.54 days a week annual leave, There's already been 5 weeks this year + 13 = 18 weeks which = 9.75 days.

You'll have used New years day, 2 at easter and early may too = -4
Plus the 2 brought forward = 7.75 days left.

If they are in addition then you'll still accrue .54 days a week, but none deducted from the balance, so 9.75 days due plus the 2 brought forward.

Edited

Thanks for your help. The BH are extra to 28 days. so it is usually 28 days + 8 England bank holidays.

So are you saying 9 days and bank holidays on top of that??

So I can take leave and finish before 6th may?

I would calculate it as 28 days /365 days x 126 days (01/01 to 06/05) = 9.66 days + 2 days carried forward plus NYD, GF, EM and MD Bank Holidays = 15.66 days.

You leave year is from 1 Jan, so 1 Jan 2025 was a BH. Obviously as you get the BHs you deduct them from the gross entitlement.

6th.

RosesAndHellebores · 04/02/2025 19:48

Two days carried forward
20/12 x 4
8/12 x 4 - 1

A/L is always rounded up to the nearest half day. There is case law.

It depends whether your contract refers to full months or not. If not 20/260 x the number of working days up to and including your last day. Also 8/260 x the working days, less one day for NY.

260 (365-104) usually based on 260 not 261.

It's the 6th.

If you give your notice on a Wednesday a week runs to the following Tuesday.
