I'm within probation
Contract says one months notice but for extenuating circumstances- well unrealistic demands and pressures I don't think I can manage another day nor want to pretend / take sick leave etc

Rather take time out for mental health

What can they do if it's a months notice and I want to leave immediately?

Potentially - sue you for quantifiable losses; although this rarely happens, it can and does happen.
Probably - give you a bad reference.

If it's a mental health reason they why not get signed off?
Is your notice period not shorter during probation, they often are.

Are you sure it’s 1 months notice within your probationary period? It’s usually shorter until you’ve passed probation.

At the end of the day there’s nothing they can do to make you stay. I’ve had staff refuse to work their notice period plenty of times and there was nothing I could do except note it in a reference request.

If you are still on probation I would think 1 month doesn't apply. What does your contract say about probation?

Practically speaking, if you're in probation they will almost certainly do nothing. IT won't be worth making a fuss about breach of contract. Your bridges will be thoroughly burnt and your reference toast, but you presumably knew that already and were willing to accept it.

Depends a little what job / level / team size and how far into training or probation you are but if is was my team I'd rather you went asap (rather than using sickness etc) so we could get on with recruiting a replacement. Our company wouldn't try to retain or recoup losses from someone in training/ probation but it would be noted on a reference.

I always see it as a test-drive (for both parties)!

Give your months notice and explain why you are doing it, then tell them that you will not be doing everything that they are expecting you to do in terms of workload as it is overly demanding / unrealistic.
Then ask them if you can leave without working out your months notice and I think they might agree considering what you have already said to them about unrealistic workload….

Be firm when speaking to them

It usually means a shorter notice period rather than none, but obviously depends on the contract.

My last few jobs, my notice period has been 3 months or one month during probation. It's often 1 week during probation for jobs with a 1 month standard notice.

I would say you'd like to resign with immediate effect and ask them to agree to no notice period. If they say no then I think you get a sick note to cover you for not going in.

This is what I did. Handed a 2 week notice in and got signed off for 2 weeks took all my things with me when I handed in my notice as I knew I wouldn't be returning

Also it was a mat cover with a fixted term
But they told me she's coming back early and then extended my probation

Yes hate doing the sick thing
But I just don't see how they expect me to deliver anything given their treatment

I've a series of emails backing it up too

I've asked for immediate affect and will see what they say

Is it a clinical role as can understand then, though I find they can leave without such stipulations
