Part time and bank holidays

My work has moved from 33 days holiday (including the 8 days bank holiday) for full timers to 25 days holiday with bank holidays worked taken as lieu days.

I'm part time. I had a pro rated version of the 33 days before. Now I have a few less holiday days as my working days don't tend to fall on bank holidays.

Is this fair and can it be changed without consultation?

That sounds pretty unfair - so full timers still get 33 days (25+8 lieu) but the only difference is you/whoever works PT is dependent on which days you work?

No that doesn't sound right. You should get a pro rata amount of the 8 bank holidays too, which you can use on a bank holiday if you wish (if that happens to be a working day for you) or else use whenever you want.

And that would also mean that part timers who work most of the bank holidays would end up with more leave overall, so definitely someone has made this decision without thinking it through!

You need to have a look at your contract and the wording around leave.

I'm not sure that it’s fair. 25 days, excluding bank holidays is less than your legal entitlement. That needs to be at least 5.6 weeks. So for you, 0.6 of 25 is only 5 weeks so not enough for the statutory minimum.

if your contract says 33 inc bh, I don’t think they can just change it. Probably one for acas.

it needs to be fair between pt and ft staff too.

To me saying you get a day off in lieu of you work a bank holiday means people are getting 25 days plus BH so 33 days in total so it's basically the same thing. If you don't work Mondays you often get the pro ratad days in lieu so if you work half time you will get 4 days ph. You get the day off if you're rostered to work but if you're never working on a BH you're still entitled to the time back.

Go onto the gov.uk website and type in holiday or bank holiday calculator and it will calculate what you should get. But if they are getting a day in lieu you are definitely getting short changed.

Thank you! Will dig out my contract. My days are mid week. I have spoken to my union's lawyer, expect to hear back in the next day or so. Must admit I don't feel fully across it and I know we have some experts on here.
