Pay error

I had two days holiday last month which my manager has put as holiday unpaid, even though I have plenty of holiday allowance.
My wages are now short by £130 and my manager has said I will receive it in my next pay which will be the end of January
Does anyone know if I should be paid before the next pay date? Not the best time of year to be short.

No, they can’t make you wait a month. They have ti rectify their mistake as soon as possible by making a separate payment to you.

Is the manager trying to cover their mistake by not sorting it out so they can just add extra hours next month?

If they say no, raise a grievance immediately. Government guidance is that they should pay you what they owe straight away, but I don’t think there is any legal obligation outside of “guidance” so you have to make it more hassle for them to refuse by making a formal complaint.

That’s just from my experience which a crappy company. Someone might be along soon with more knowledge!

Depends what the company polices say for underpayments

I used to work for one of the big utilities and it happened ether manager didn’t authorise overtime before cut off date or employee forgot to do time sheet
it was very clear in our HR policies we had to wait till the next pay date irrespective of who made the error
it was challenged many times by the union but policy stood

so yes they can make u wait

bit pointless with grievance if you think company aren’t going to back down
that process could take longer than waiting till the next payday

You can request and emergency payment is pushed through… depends how many people in payroll are working right now as to whether they can. It’s crappy.

No, this is unacceptable. Ask for a sane day payment to be made on Monday, whilst it is sorted out.

It might be pushing it to get an emergency BACs through by Tuesday, Xmas Eve, but they ought to do it for you in the NY and before you go short.

I'd ask for an advance of about what they owe you less tax /ni.

Then fix it in next payroll run and take beck the advance.

Re-running payroll may be a huge hassle. Paying an advance is usually easier.

I'd be grateful if you could specify the law and legal process for this assertion. Because at least one of us knows it isn't true. That would be me.

OP - you might be able to get an advance, but that is at the discretion of the employer. You have no legal right to enforce an earlier payment, so it is up to the employer. But they can certainly make you wait until your next payroll run, and there is nothing you can do about it. It would take many weeks to go through a process of forcing a payment in law - many more weeks than your bext payroll.

If it’s going to impact things like student loan payments etc then make sure they’re aware.

I had one month where they messed up and I agreed to wait for the next month to receive the missing money. It didn’t occur to me that it would tip my earnings that month over the threshold to make a student loan payment. So I was worse off due to their error!

if I’d had realised I’d have pushed much more for it to be rectified.

Most (bigger) companies won't make payments 'outside of scheduled cycle' because it messes up their accounting. They would only make exceptions in extraordinary circumstances and £130 is not.

If you work for a small business, for example Kathy's cafe of which she is the owner and likely doing her own payroll, then you may have a chance.
