Redundancy notice period

Hi,
I have unfortunately been made redundant and I'm questioning my notice period. I have been continuously employed by the company for 7 years as reflected in my redundancy pay, however they are only giving 1 month notice as per my contract. I have read that you should get 1 week for every year worked, I have also spoken to ACAS who confirmed this. My HR department are saying ACAS are wrong.
Could someone please advise .

Redundancy pay would be 7 weeks if policy is statutory only, plus your months notice which you may be required to work or they can pay in lieu.

No, you’re entitled to not less than one week’s notice per year of employment if you’ve been employed for more than two years and less than 12 years. Tell your employer to refer to the employment rights act. Your contractual notice period would be relevant if it provided more notice than statutory.

You should get a weeks notice for each full year worked. Even if your contract says less they must meet the statutory minimum.

Well yes, but both statutory redundancy pay and statutory notice are based on weeks per number of years service. If OP has 7 years service she should get at least 7 weeks' pay as her redundancy payment (more if contract specifies more) and a minimum of 7 weeks' notice (regardless of if contract specifies less, statute overrides contract). The notice can be worked as a notice period so her last day of service should be no sooner than 7 weeks after she was served notice, or if contract allows, some or all of the notice can be paid in lieu...

My company are saying they will only give a month as I changed roles in March 2022, but they won't acknowledge 7 years continuous service which they have with my redundancy pay.

My notice period is being payed which is why I'm trying to get the full 7 weeks.

If you are aged 41 or over you qualify for 1.5 weeks pay for each year. As long you worked the same hours in each job, the fact that you changed rules won't matter.

Remind HR that the contract cannot give less than the statutory minimum notice and any contractual term that purports to do so is invalid. You may want to point them at Dismissal or redundancy - Notice periods - Acas
