hi all hope someone can help?

I would like to know if you can prove/file a case regarding unfair dismissal after the event as it were.

i have recently found out that when i was made redundant last year my employer knew i was pg, this was not disclosed by myself to the employer and i was not given any notice in regards to the redundancy,it was not expected, came directly after a review and pay rise , and it is likely that this is the reason as i was the only one made redundant.

i dont know whether i could prove my case as it would be my word against my ex employers and most evidence would be just that - things said to me by other employees ( it was a family firm and everyone knew everyones business) i was told by one other employee (the owners daughter!) that if i was planning kids anytime soon i should leave and it was hinted that this would be a negative, i foolishly thought that i would be fine, and didnt heed the warning. i was made redundant and when i (in a very distresed state ) said i was pg i was told that they knew . . i found out after i left that my co worker was alaso pg and she said she was told this is the reason i was made redundant - the company couldnt afford to support both SMP claims. The business has also taken on new staff since i was made redundant, not in my role, in a very similar role...

So my questions are:

Can i file a claim this late ( it happened in june last year)?
and
How would i go about it/proving it?

i would of done it at the time but i was very distressed and subsequently had a mc so was a bit pre occupied...

You could start by speaking to ACAS/the Citizens Advice Bureau.

Though I'm pretty sure they can reclaim SMP so if this is the reason they were a bit naive!

Hopefully someone with better advice will come along soon :D

They can reclaim SMP from the government. The Equal Opportunities Commission have a helpline you can call however, you only have three months to file a claim though. I am so sorry about your loss but this doesn't affect the three month time limit. I'm very sorry.

nobody I'm afraid it is too late for either unfair dismissal or sex discrimination, which both would have been options you could have considered.

In answer to your other question, you may well have had a very difficult time proving anything anyway, so filing claims may have been difficult/stressful/expensive.

I'm sorry you've had such a rough time since then as well. I wish there was something more constructive I could say to help. It's not very helpful but the only thing I can say is that it's been a while now since it happened, see if you can find it within yourself to focus on your future and your family's future, whatever you might want to do, and rather than expend energy and stress thinking about the injustice that was done to you back then, expend it as positively as you can on whatever lies ahead for you.

I know all that's easy for me to say, but if you can let go of something that you can't do anything about and think forward, it might help.

thanks guys, me and dp currently TTC, and i am happy in much better job, just annoyyed with myself for not thinking of it at the time, wanted to take the bstrds to the cleaners after what they did to me! hate the thought of them doing it again, but as you said ive done all i can, thanks for your support and kind words x
