Unfair dismissal

Hi I was sacked from my job in March this year and I managed to get it back through unfair dismissal, I got into debt etc because of no pay, I've been back in the same job for 4 months now but I'm still struggling with debt caused by the dismissal, do I still have grounds to sue after so long?
I'm worried I've left it too long to claim now even though I'm still struggling because of it. Thank you

Was there not a financial agreement as part of your reinstatement? How long were you without pay?

BabygirlTom · 13/08/2024 13:50

Do you want to lose your job again?

McSpoot · 13/08/2024 13:53

If you were dismissed in March, that's no more than five months ago. You've been back in the job for four months, so you were off for one month? So, lost one month's pay? As a PP asked, was there no backpay as part of your reinstatement?

ttennisha · 13/08/2024 14:28

I got back pay for the month for the time I didn't work but I get paid every 4 weeks so the one month that has 5 weeks in I get an extra pay, it helps to cover bills etc, the month I was sacked was the month I was supposed to get the extra pay but I didn't, they paid me loss of earnings but it was in 3 payments and it messed up my UC so one month I I didn't receive any help from UC because the back pay made it look like I earned over the threshold but I didn't so now I'm still in debt because I still haven't recovered from the dismissal

If they already paid you for the gap when you were not working then no.

How?! It can be done, it wasn't my fault I was sacked and others has sued, won and still turned up the next day?! I was offered the chance but thought I'd be okay at the time and I was told I could still claim after too but I need more info before I go jumping in. I need genuine answers not questions like this. Thank you.

You would have received more UC for the period you received no pay surely? You get paid 13 times in a year so you will always have one month where you don't get UC or get less because you receive 2 pays.

user68712226 · 13/08/2024 14:36

You cannot claim. You have three months less one day from the date of dismissal to claim. This is extended if you have used Acas early conciliation. You are out of time

I know what you mean about the UC, OP, I understand the erratic / clustered payments messed it all up. It feels very unfair doesn't it. I had a situation at my work where they didn't pay me one month so paid me twice the next, and whilst my work pay was right I lost hundreds in UC because of their error. So I know what you mean.

But, if your work have back paid you in full, I can't see you have any kind of case for them compensating you over your loss of UC. I'm not an expert though.
