Teenage summer job ‘self employed’

My dd 17 has just been offered a job working at a school holiday club,
the company that runs the clubs does so over many sites and have been running a long time so hopefully it will be a good experience for her.

I have been reading through all the paperwork and it says she will be self employed, ie she can chose the days she works and isn’t entitled to sick or holiday pay.
Then it asks for details of accountant if applicable.

So do we/she need to do anything regarding declaring her earnings to HMRC?
I’m clueless on the matter and don’t want to get it wrong.
she won’t be earning enough to pay tax I’m sure.

Just been having a nosy on their website.
This is on the parent bit.

It also states they are fully covered with public liability insurance.

The difficulty is that dd really wants the job. It’s perfect for her on paper.

I think I’m going to email pretending to be dd asking to clarify the insurance situation and what she needs to do regarding paying tax and see what they say.

I’d be telling them my SE rate was £20ph! How disheartening for her though.

There are companies near me that are advertising quite often for ‘self employed’ staff…..then dictate their T&Cs in the same advert.

If she wants the job for the experience and income, she could take it and report them later.

It sounds like the company is big enough for them not to know who did this.

Dd took the job. Absolute shit show from the start. Supervisor quit within 4 days so dd was promoted to supervisor. No extra training. But higher rate of pay promised.

Constant staffing issues, contact from higher up non existent. Dd just left to cope.

Meant to be paid on Monday she still hasn’t been paid. Bullshit excuse yesterday about can’t pay as they don’t have her cv!
2 others haven’t been paid that we know of.

where do we go from here?
Who do I need to report them to?
Im happy to take them to small claims if needed.
My younger kids go to the school it is held in. Would you speak to the school about it? Just as a heads up about what is going on as they are advertising this club.

they owe her about £750.

Dd has just been informed that no one on her site has been paid!
So I’m assuming cash flow issues for the shit fake excuses.

You were warned that it was dodgy and surprise surprise it is.
Sucks for your DD but from your original post being paid properly and promptly would have been a pleasant surprise.
You can look at the Small claims court and go that route, probably your best bet

My initial inclination would be to report it not only to HMRC but to Ofsted or whoever registers the club as well.

Report them to HMRC for false self employment and report to OFSTED if they are registered with them. Raise it with the school too.

this was as dodgy as fuck from the start so don’t be surprised if she doesn’t get paid!

Yes I completely agree that she shouldn’t have taken the job.
I raised my many concerns with her at the time and throughout the summer holidays when things cropped up. But ultimately it was her choice whether to take the job or not.

While I had concerns regarding their business practices. I didn’t have worries about her being paid as this club has been running since she was at that primary school. With many returning staff members so I didn’t have reason to think they wouldn’t pay her for hours worked.

How long would you give them to pay before starting a case in small claims?

Whats the payment terms in the contract?
Write to them quoting the relevant part and giving them 7 or 10 days to pay in full after the payment due date or tell tham that you will go the small claims route.

Some others have had their pay docked for questionable reasons!
So that side is sorted.

I will talk to the school at pick up this afternoon and then report to ofsted and HMRC tomorrow.

Make sure she has any tax or NI put aside if due to HMRC involvement she needs to pay anything

No. If she was actually Self Employed, she would be invoicing them with her own rates and her own hours. If she's on NMW but not actually accruing any holiday hours or having Employer NI paid, the time taken to do basic bookkeeping and file her Self Assessment return, then she is essentially earning less than the NMW, not to mention losing out on Workplace Pension eligibility. The amount of rules this company are breaking is off the scale. Report them to HMRC immediately.

Report to ofsted is done.
Had a long chat with the headteacher who was very interested and grateful that I let him know.
Struggling to find how to report to HMRC as none of their reporting options seem to fit.
