ACAS Early Conciliation process

Afternoon,

Has anyone here gone through the ACAS Early Conciliation process?

Did you involve ACAS while your grievance was under investigation, or did you wait until after? I’m considering the former.

What led you to purse early conciliation and how did it go?

If you initiated early conciliation during the investigation phase, did the agreement reached affect the investigation’s outcome? For example, did the individual you filed the grievance against avoid consequences due to a settlement?

@Quirkyme it's bitter sweet isn't it. Because I know I didn't go into this industry for money !

I hope you get the outcome you need and it's over quickly for you. One positive I can say is LAs love to document stuff which in my case at least placed into my favour.

If you ever need someone to vent to or if anyone has any questions just pm ! Lets the post updated !

So to update for anyone who comes across this and thinking WTF.

I have agreed settlement. I can't talk about the specifics of it but I can say it's a years worth of peace of mind, excellent reference and probably a fairly large amount of therapy needed.

Things that helped was I had an extensive paper chain. My lawyer was chuckling when I presented him with the info. He said it's always remarkable what people are silly enough to put in writing.

This is first and hopefully last time I ever have to go through this process. And I'm not gonna lie it's been LONG and stressful process, I can only speak for myself but I have found it a really disheartening process people show their colours under pressure good and bad. I feel very naive, I certainly was when I raised it in good faith. I didn't want to end up here.

I didn't want to whistleblow, people assume all types of bollocks when you mention raising a grievance or whistleblowing. Like the default is you're a trouble maker or wanting a payout.

The sad matter of fact is that it takes people a massive amount of courage to do this type of thing. Esp what I reported, and I really am your average Jane. I'm not loud or someone who is looking for a pile of cash, I wanted to do a good job and come home

. I was just someone who saw something, reported it and faced discrimination because I was trying to do the right thing.

Even though it's against law- it's frightening how so many people forget that fact.

Also if anyone still has ambitions into go into local government. Don't.

Congrats. mine is still active awaiting a response for ET claim from my employer ( should be due soon) . However, I am today officially free from LA as I got a new job.

Even at the last attempt, my LA employer disclosed my sickness absence which related to my disability to my new employer at reference stage hoping to ruin my chance. Thanks god, my new employer didn’t care too much and offered all the support I need to start my job which something my employer of 7 years failed to do.

Acas gives you an extra month so it can be extended to 4 months minus 1 day. So I started the conciliation process 2 months after my formal grievance as they hadn't done anything with it other than push me to resolve it informally.
I got a near 3 figure settlement for disability discrimination. In a much better job now. Wish I'd left sooner but then I wouldn't have gotten my settlement and walked into a new job immediately afterwards.

Thank you. I hope so too, I really want nothing to do with LA anymore and never wish to hear from
them again. They even had a cheek invited me for exit interview 😅.

Hello, I know this is almost 2 years old, but I’d love to know how you got on. I’m in a pregnancy discrimination claim process. I’m about to submit to ACAS:
I have a good solicitor, but the employer has not responded in a meaningful settlement way. Instead, they have engaged a sharky firm to threaten me. Their rebuttal contains mischaracterisations and exaggerations. It’s clearly designed to scare me off. I just want the company to come to the settlement table.

Specifically, do you know if ACAS are completely neutral or do they probe things that might make an employer think twice about digging in. This is a private company, owner occupier. Thanks if you’re still reading. I really really don’t want to get all the way to ET.
