FLOWERYBEANBAG and anyone else "in the know" - Can I have your help, pretty please? Maternity / Bank Holidays question.

Hi. I recently saw a thread dealing with the issue about Bank Holidays and entitlements for people who do not usually work on Mondays or Fridays.

I was absolutely mind-boggled by the info that was given, but Flowerybeanbag seemed to know her stuff. So I was hoping that someone would be able to help me with my dilemma.

After my full maternity pay ended I am now entitled to 1/2 pay. I have now returned to work under a scheme which means that I work 18 hours and still received full pay.

I work on Tuesdays, Wednesdays and Thursdays for 6 hours a day. I am being advised that I am not entitled to any additional time off for Bank Holidays. My logic is that I should still be able to have some additional time off on the basis that I am still in theory working full time. Can anyone advise?

funkynora that sounds like a good deal!

As far as the law is concerned you are working part time and just getting paid a lot, there's no 'theoretical' full time.

So as long as you are getting the appropriate holiday entitlement for someone on 3 days a week, that's fine.

I should have said that I am only on this scheme for 24 weeks, then back to working full time.

My holiday entitlement, for example remains as per my usual full-time entitlement. I am still considered as full time and not part-time.

Does that make any difference to your answer? Thanks again.

If you're being paid full salary but only working 3 days then you are getting all the bank holidays off paid anyway, no?

Am I missing something?

I'm confused too - you are already having those bank holidays off anyway? And being paid full time? So no issue surely?

Sorry, Sorry. I am not doing well here at all. (My typing isnt keeping up with my brain).

My original post should have said full time staff get an ADDITIONAL day off for Bank Holidays. Just querying whether i'd be entitled to the additional day.

How do you mean an 'additional' day? Additional as well as what? I am confused!

A full time person works (say) 5 days a week, there is a bank holiday on the Monday, they don't come in. You work 'full time' but only do 3 days a week, so you get paid for Monday and Friday without coming in.

The whole holiday for part timers stuff is about are you being disadvantaged compared to full time staff. I don't think you could say you are....

Im really sorry that my explanations are so crap!

A full time worker would not come in on Good Friday or Bank Holiday Monday. They are also entitled to a FURTHER day off. Our Local Auth calls it a 'recess day'.

There are 4 such days each year. Staff who are on job share are entitled to half of that.

Hope that's clearer.

I know that my current work arrangements are exceptional, but my employers make me feel like I am being ungrateful.

Im sorry for not posting clearer information in the beginning. This is doing my head in as it seems like I have lost out somehow.

You have confused me with all the talk about bank holidays, when they aren't bank holidays at all.

So a full time person gets (say) 25 days holiday, 8 bank holidays and 4 'recess' days? A part timer gets (say) 12.5 holiday days, 4 bank holidays and 2 recess days?

Presumably these recess days are specified when they are, so they are not just added on to annual leave? And, like the bank holidays, you already get them off paid?

I can't see you have a legal basis for more time off when you are already getting the same time off as everyone else and being paid for it tbh.

The recess days entitlement is attached to bank holidays.

It seems that I have lost my recess day entitlement while I am on this scheme. I am still waiting for advice on this from my union rep - as my HR dont seem to really know for sure and it is not documented anywhere in our terms and agreements.
