Enhanced maternity pay on a fixed term contract

I recently found out I’m pregnant and am on a fixed term contract which I have been told will be renewed for another year soon. I am due in early August and my new contract will run to at least end of March 2024 (still to be confirmed) but may run a bit later until May/june.

I work for a charity which has enhanced maternity pay for all employees, which is the same for SMP. There is a clause says I need to work for 6 months after to be able to claim this.

my question is whether I will be able to claim enhanced maternity pay given that my contract may technically expire during mat leave (though I’d only take 9 months)

there is a chance my contract would be renewed again (if we get another years funding) but as usual in the charity sector that isn’t a given, and we would only find out towards the end of this year. So a decision would need to be made before this.

does anyone have any experience of this?

There are charities that advertise pregnant women on maternity rights. Can't remember their names but they definitely exist

You are entitled to the same terms used conditions as other employees unless its specified in your contract otherwise.

If your contract is not renewed then there should be no requirement to replay and you should also receive redundancy pay if you've been employed longer than 2 years.

If you have any problems with your employer give ACAS a call for advice.

My contract expired - I got the additional pay and did not have to pay it back. I also got redundancy pay. Unfortunately this was all paid in a lump so I also got massively over taxed.
