flowery, or anyone please help, when handing notice from mat leave, my company say your employment is terminated from when they are informed you are not planning on returning.

flowery or anyone, Hi MN regular, name changed.
im due to return to work next month, i do not want to return. just ben going though my maternity information from my company with regard to handing in my notice,

my contract states i must give two weeks notice.

the maternity information states, your last date of employment will be either

1.the date you informed us of your intention to resign
2.the date we received your undated notice of resignation

  1. the date of termination of your employment, if we haven't been able to contact you or heard from you

the problem is i get a bonus on friday the 18th of april [this bonus is quite large]
and im due to return to work on monday the 21st of april.

so what im trying to figure out is, if i give them two weeks notice, say on the 7th of april, will my employment be terminated on the 7th, therefore maning i won't get my bonus on the 18th?

id really really appriciate any help,
as i can't afford to miss out on this bonus.

OP sorry to add to any confusion but have you checked whether the bonus will be paid if you hand your notice in. Lots of schemes do not pay the bonus if an employee has given in their notice. Or is this not an issue?

unsure if you are certain that you haven't had any contract amendment stuff then your notice period is what it says in your contract, and you will be fine handing in just two weeks notice as opposed to 28 days.

I would suggest you check the details of your bonus scheme as maisy says. If it does say not payable to employees serving their notice, depending on the size of the bonus in question, it may be worth not giving notice at all, or hoping they don't actually make you come in and work and let you have it as holiday instead.

I know you're very nervous of doing that, but might be worth checking anyway if you haven't already.

hi masiy thanks for that, i will look into it, as if it means i dont get my bonus it might be worth not handing my notice in,

hi flowery, thanks again for all your help, id rather not give notice than go back there, ever!
as they did treat me really bad when i was PG..
flowery does it seem weird to you that when i changed stores, i never had a new contract or even a lettterto confirm this.

also i promise flowery this is my last question on this,as i realise i have chewed your ear off, say i don't hand my notice in, that way i would def get my bonus, i have no plans to ever ever go back to there, so if i just avoided answering my phone if they call me to find out if im going back, then when i do actually hand my notice in, i could just say, oh i did snd you it, must of got lost in the post,

unsure it doesn't seem particulary weird unfortunately. You should have a letter confirming any changes to your contract, but some companies are a bit rubbish about things like that.

You could say your notice had been lost in the post, but things being lost in the post doesn't actually happen that often. I think your best bet to be sure is to check your handbook or wherever it says about your bonus, and as long as it doesn't say anything about 'not payable to staff serving notice', hand your notice in, I think you'll worry less then!
