I work 10 hours a week. I do one 8 hour shift and one 2 hour shift. We have a points based system for illness.

If I happen to be ill on the day of my 8 hour shift and phone in sick, the way the sickness policy works I am recorded as having 8 hours sickness. This is 4/5 of my working week. It is the equivalent of a full time staff member taking 4 days sick.

So in the past year I've had 3 days of illness (separately) but because my sickness is pro rata it's the equivalent of a full time staff member having 12 days off. I've had to have a meeting about my sickness record.

It feels like part time staff are penalised can I challenge this at all? My thoughts are a day should class as a day. Not the number of hours

@Autiebibliophile HR will look at this in a different way.

I am assuming a full time employee works 5 x 7.5 hour days 37.5 hours a week Monday to Friday.

You work 2 days a week 10 hours in total so 0.27 of full time hours. This averages at 5 hours per day.

If the sick policy for full time staff is 12 working days or 3 absences then you are entitled to that pro rata as follows:

  • 3 instances / 5 x 2 = 1.2 instances round up to 2 instances.
  • 12 days /5 x 2 = 4.8 days x 5 hours average = 24 hours.
  • 12 days x 7.5 = 90 hours x 0.27 = 24.3 hours round down to 24 hours.

I would say giving you the 3 instances as a review point is more than fair.

I can see why you feel the 12 days is unfair as it is pro rata based on you working 2 x 5 hour average days a week.

However, if you had 3 x 8 hours days sick = 24 hours, this is equivalent to 12 working days (90 hours) for a full timer. This is fair as it is equivalent to 12 x 7.5 hours.

Had you been sick on your 2 hour days, whilst you would still have had 3 instances, 3 x 2 hours = 6 hours is equivalent to 1.2 days for a full timer (I think) and so under the 12 day equivalent and I would expect your manager to acknowledge this.

If you had a weeks sick it would be 10 hours or 2 days equivalent to a full timer having 5 days or 37.5 hours.

I hope this makes sense and explains why it appears it was fair you were referred.
