Shared Parental Leave and New Job

So we have completed all the paperwork and have SPL agreed by both employers.

My wife is currently on Mat Leave due to return to work in Jan, at which my Paternity Leave will start.

However she is interviewing for jobs. If successful and she accepts a new job. What impact does this have on my SPL entitlement? Anyone know or have experience?

@Charcol you have used the terms paternity and SPL which are different things. Paternity leave is for the partner only and has to be taken within 56 days of the birth.

I assume your wife is on Statutory Maternity Leave (SML) and plans to start her new job when this ends. She has signed the declaration to end her SML in January and for the remaining leave to be taken by you as Statutory Shared Parental Leave (SShPL). As you are remaining with your current employer you are still entitled to take the SShPL from January.

The issue would be if your wife started her new job whilst on SML or SShPP as this would immediately end her entitlement.

@Sisterpita Ooops yes using terms interchangeably.... my bad.

So I mean I will start my own enhanced SPL from Employer in January.

She is currently on her own employers ML. And as you rightly explain above yes, she has signed for me to use the remaining SPL from January.

However, my Q is does her curtailing her leave, and leaving her employer before January. Affect my own Employers SPL that I have planned.

My gut instinct is no it doesn't so long as all policies have been followed. But wondered if anyone else knew or had been through it.

You will be fine because you both met the eligibility criteria and you are not changing your employer.

As far as your employer is concerned your wife has ended her SML and is just returning to work, the fact it is for another employer is irrelevant.
