Help - redundancy question

Hi,

Being made redundant. Was offered to apply for other available roles. Applied for 1 that was fixed term (I am currently permanent).

Being asked to confirm my preference of either the fixed term or the redundancy.

If I choose fixed term, can I retract my application and still get the redundancy seeing as the role is not a "suitable alternative" due to being fixed term and not permanent.

I am having interviews elsewhere, reluctant to lose the redundancy by saying my preference is the fixed term when I might in fact retract the application and take redundancy if offered a role somewhere else. (Also don't want to lose the fixed term of unsuccessful elsewhere).

Confirmation of redundancy is not due for another 2 weeks, so assumed I had another 2 weeks to decide on withdrawing my application for fixed term to take the redundancy.

Hope this makes sense.

In my organisation, if you were successful in getting the fixed term role the employing area would be responding for paying your redundancy if there wasn't a suitable perm alternative at the end of the FTC.

I think you can ask them to confirm in writing what happens at the end of FTC if no role available, its a totally reasonable question.

A fixed term position is a potentially suitable alternative in law, because effectively all it does is delay possible redundancy. The fact you applied for it strengthens that argument. If you now turn it down if offered, or withdraw, that might be used to argue you aren't entitled to redundancy pay, and if it went to law that argument might be very strong. But nobody can tell you whether that is what your employer would do. It's a gamble you have to take.
