How does sick pay work?

I know it will likely vary employer to employer but how does sick pay work?

My employer isn’t great and only gives 5 weeks full pay for sickness, then you go to SSP.

I am off just now with work related stress - when I return to work I will have been off for 6 weeks.

I am expecting to return for about 4 weeks then need to have a small operation and will be off for 4 weeks.

So is the 5 weeks sick pay per illness, or is it per 12 months? I don’t really want to turn on my laptop to check the handbook but might have to 😕

I am not sure where I stand can someone explain this procedure to me please. I have raised a formal grievance I have had the meeting to explain my claim. Now it’s unlikely that the employer’s investigation will be complete sooner which means if I wait for them I will miss the 3 months 1 day rule. Now I am thinking of filling the acas reconciliation form to be on the safe side, however I am not sure of at what stage will acas inform my employer as I am hoping not so soon to allow them time to investigate or do acas do inform my employer as soon as I fill the form?

I had a friend who had to sell her property and move into a bedsit as while she was off having a hysterectomy for cancer treatment and then chemo and radiation her employer (who I think should be named and shamed) only paid SSP. It was heartbreaking for her. We all tried to raise as much money to help her.

I get 12 week full and 13 week half and I see colleagues regularly taking the piss and deliberately using it up each year ‘cos they can’

personally id rather it be managers discretion - I see many colleagues go off with stress for 12 weeks then suddenly return when they know they’re going on half pay. It’s so obvious

Im not suggesting that’s case with you OP but in my work coming back after 6 weeks when you’re sick pay runs out just before would look suspicious

Statutory sick pay paid for Maximum 28 weeks sickness. The first 3 days of sickness don't count, those are waiting days. Any company sick pay is discretionary, and should make up the shortfall between statutory sick pay and your normal wage. Some businesses pay 6 months company sick pay, some none, just depends on contract conditions. If you have a "spell" of sickness (say your five weeks for instance) and then return to work your next spell of sickness will "link" if it is within 12 weeks of your last day of sickness. The count towards the 28 weeks maximum will restart (no additional waiting days). If you carry on being sick and exhaust your entitlement your employer may keep your job open on nil pay if you are going toget return but they are not obliged to - can pay you off on inefficiency grounds if they want. When your SSP exhausts they should give you an SSP1 FORM so you can claim employment and support allowance - this is awarded based on national insurance contributions. Hope this helps.

Sorry, should have added, you may qualify for a top up of universal credit if you are off sick depending on your circumstances. Try checking one of the online benefit calculators the Turn2us one is good.
