bullying conclusion after investigation

Alexxxy · 18/06/2023 19:30

I reported few incidents at work and they were investigated and the conclusion I was told is that I have been bullied no writing outcome yet. What would you do next? I also suffer from anxiety depressed and my Dr has prescribed more medication for worsening mental health.

No idea but sounds awful! Hopefully the bullies get their comeuppance!

It is awful indeed.

I would wait for the written outcome. I would also ask whoever is in authority on the investigation to confirm that your performance rating isn't adversely affected by the bully particularly if there is a negative impact on pay/remuneration. Often a bully will try to point the blame on their victim that they weren't doing their job to besmirch their professional reputation and make out they deserved being bullied. Head that one off, while you have them confirming the bully was in wrong,

If possible I would seek redeployment to a different manager.

I wouldn't see it my place to know the details of how the bully will be "punished" but I would make the point that they need to be suitably reprimanded so they change their behaviour.

Whatyoutalkingabouteh · 19/06/2023 12:21

You won’t find out what happens to the bully as this is confidential- I’d hope disciplinary action!
However they need to support you to move on - was this discussed at all during the process? Ie mediation with the person or a managed move? You shouldn’t have to move from a job if you weren’t the bully.

Alexxxy · 19/06/2023 13:39

Thank you for your comments. I was bullied by 4 staff members I reported it and the manager ignored it until it got worse then I have to do informal grievances. I am
waiting for a letter then I will take it from there. I feel I have been discriminated against due to my protected characteristics it is very very clear because some words were indirectly used that describes my protected characteristics it has been awful still is I deed joint to work.

@Alexxxy As pp said you don’t have a right to know what happens to the bullies. They will have a right of appeal.

The next steps should be what is your employer going to do to prevent the bullying going forward and helping you continue to work effectively. A couple of things to consider:

  • Guarantees regarding you performance and that interaction with the bullies is kept to a minimum
  • everyone given Diversity training
  • an apology from the bullies
  • having a mentor/coach appointed who you can go to for coaching/support
  • a nominated person you can report any further incidents of bullying
  • if you think it would help, ask your employer to pay for counselling
  • mediation - this doesn’t have to be face to face but it may be appropriate in this case. If you still have to work with these colleagues it can be a way of drawing a line and moving forward.

Do you want to stay?

I only ask as, if it's contributing to your poor mental health, unless you absolutely need the salary, I'd be thinking about looking for another role and resigning.

Unless there's a huge culture shift, or enough of the 4 people leave to change the dynamics, I doubt things will change enough for you to feel happy.

You don't deserve this. Keep your chin up, and if I was you, find a more positive workplace.

I like my job but getting bullied isn’t fun at all. I await the outcome letter and take it from there. I don’t think bullies would want to leave as it is a very good place to work I think I am
the one who will have to leave.

How long was the investigation OP.
I'm in the same position 3 of the 2 badly have harassed and ostracized me for around a yr.
I too have a protected characteristic and await a decision.
Sorry you've been through this. It is a dreadful thing.
I'm unsure about staying as I want a clean slate tbh.
Only went formal as I had had enough.

Tipping advice do bullies apologise?

Sorry you are going through this horrible situation.
Well, mine has turned out worse they did not investigate my grievance instead they investigated something that happened in February which was a misunderstanding which was resolved then. So I raising formal grievances and see where we go from there it’s very sad as I like my job but I have to leave for my wellbeing.

I am not sure where I stand can someone explain this procedure to me please. I have raised a formal grievance I have had the meeting to explain my claim. Now it’s unlikely that the employer’s investigation will be complete sooner which means if I wait for them I will miss the 3 months 1 day rule. Now I am thinking of filling the acas reconciliation form to be on the safe side, however I am not sure of at what stage will acas inform my employer as I am hoping not so soon to allow them time to investigate or do acas do inform my employer as soon as I fill the form?

Ah no.

Tippingadvice · 25/08/2023 22:11

I think you can lodge with ACAS and the employer can ask for it to be put on hold whilst they complete internal investigation.

You could explain to your employer you are lodging due to timescales.

Talk to ACAS as they can advise on timescales.

If you are a TU member they may be able to help.

Sorry you are in this situation. I'm waiting for my conclusion in the next week.
It drags doesn't it.
I'm my case things got worse now I feel like outside managers have turned things round a lot for me.
I'm still looking for a better fit though as I'm sure my colleagues just don't like me.

What an awful thing to happen to anyone keep going and hopefully get some justice. This is so like my situation lots of bullying from colleagues and management. I agree with better fit though for peace of mind it drugs but next week isn’t that far.

Having submitted your grievance, and provided you are confident you have sufficient legal grounds to take your employer to ET, there is nothing to stop you submitting your ET 1 to the Court process which ithen goes to your employer. That means you won't miss your 3 month deadline. I hasten to add, please get legal advice to ensure you have a sound case.

ACAS then get triggered to offer Early Conciliation.

if anything submitting your ET1 will force your employer's hand if you think they are dragging their feet and playing for time. They'll try every trick in the book, believe me!

Banditqueen12 · 26/08/2023 11:34

I am slightly confused - your post in June suggested that you had been told that the outcome of your grievance found that you had been bullied. So if you know what the outcome was in June, why do you think it is still ongoing?

Yes I raised informal grievance so that was the conclusion you are correct. I then raised formal grievance as some of my informal grievances issues were ignored.

Yes, only way past this was to leave.

Got told I was having an exit interview that was of upmost importance, but in harsh reality this was literally a one liner of anything you want to share with us? (after receiving happy to receive your resignation) it was far, far from an exit interview!

Companies do not want to get to the bottom of it.
