6 month probation

Hi I am in my probation period.

I have a disability and had a fall again but this time I have really hurt myself. I doubt I will be able to drive.

Can work sack me if I ask to work from home?

Should I call HR?

Reason being, they do not like people working from home and they terminate a lot of people.

Bit harsh to terminate if you have to wfh, i guess are you able to do your job fully from home?
just talk to your manager and HR

Yes, it's a hybrid position, but like I said they are very strict and are constantly terminating people.

I told them I had a disability on my medical forms. One manager also saw me fall into my desk the other day. Lucky the desk was there really.

They can fire employees for any reason during probation BUT as you have a protected characteristic via your disability/health issue they can not fire you for that is my understanding. That's unfair dismissal, take a look at the citizens advice website on this.

You are covered by the Equality Act 2010, remind work of this because if they should even threaten you with dismissal without making reasonable adjustments, such as working from home because of your injury.

Don't let them put you on edge about this OP, just get yourself into a union asap and the union will help you, see go to the Acas website for details.

Is there a way I can word it when I call tomorrow, so that am treated fairly and they know that they should help with reasonable adjustments?

People assume that the Equality Act provides more protection than it does.

OP, you say that you have had a fall again. How often are you falling, and if you are at such risk of falls, how are you managing that? In the end the employer may need to consider adjustments, but nobody here can tell you whether thse asks are reasonable or not - we have no knowledge of the circumstances, and they are all different.

However, like you, I am disabled and have a strong risk of falling. It isn't generally down to my employer to manage that. They can manage my desk and chair and such things (including my workplace or working from home) but as a general rule, unless they are doing something that increases my risk of falling, then that is something I must manage. Surely if you are working from home, you are at the same risk of falling? And also, sorry, but if you have really hurt yourself (and I am not saying you haven't, just saying if it is that bad) then you should not be working - such injuries can be exacerbated by working, even if that just means sitting at a desk. In some cases, especially by sitting at a desk.

You're right! Trying to work when I have a disability without any type of support and risk of being terminated all the time. It's just not worth it.

@nenos is there support your work can provide, and if so, have you asked for it?

I suggest you email your manager and cc HR and state as declared I have x disability which makes me prone to falls. Due to my disability I fell over at work yesterday. Unfortunately the injury I sustained (give details) means I am not able to drive, but I am able to work. To enable me to recover from the injury and to continue working I am requesting a short term reasonable adjustment to work from home. I am happy to contact my GP and request a fit note supporting my request.
