Sickness during notice

I’m suffering from severe work related stress due to my boss’s behaviour and have decided I have no option other than to resign. I have a 3 month notice period and am currently off sick. When it’s clear I’m not planning to go back during my notice period can my employer shorten it? I don’t want to agree a shorter notice period as I want them to pay me for the 3 months. They should be offering me a settlement really but I don’t think they will and I don’t have the stomach for a fight.

If contractual notice is 3 months they can't shorten it. But have you read your contract thoroughly because a lot of places now have clauses that prevent occupational /company sick pay during notice periods.

You could ask for payment in lieu of notice or to go on garden leave?

I suggested discussing exit terms and she’s ignored me so I fear that she’s going to play hardball. She’s inhuman, horrible. I think if I ask for PILON they’ll more likely offer to waive the notice period and then I won’t get paid.

No they won’t shorten it. I too felt the same and even when given an informal pip after return to work following sickness and then a new employer approached for a reference early doors before I had chance to discuss anything with anyone, my then Manager said well I require full notice as per contract on taking my word of resignation. Very large company.

1 week but I stayed 9 days in reality under notice, and in reality I did 2 weeks notice, pretty amicable ending. (((Thankfully only so glad I didn’t burn bridges in getting funny that I wasn’t working notice))).

Possibly different in a very small family company you’ve worked for 6 months for example or in a sales role but certainly in a large company you are not let of the notice to be worked.

They can’t unilaterally waive your notice period. They can do PILON or gardening leave. Or make you work it. Is there an HR person or anyone above you horrible boss you can approach to discuss exit?

maybe try citizens advice or ACAD - someone you can discuss specifics and contracts with.
