Redundancy & ring fencing

My employer is shortly due to announce a departmental restructure. It is highly likely that I will be ring fenced to another (slightly higher level) role with slightly higher pay.

Presumably this will involve a selection interview, though there are 2 new roles and only 2 of all the current employees are qualified to apply (I am one of them).

Does anyone know at what point I could leave and still keep any redundancy payout? At what point am I “at risk”? Once the restructure is initially announced? At any point during the ring fence process? Or do I have to wait until I’m (hopefully) rejected from getting the new higher role before I’m eligible for redundancy pay?

If you leave voluntarily at any point in the process, you will lose the right to a redundancy payment unless you are taking up an offer of voluntary redundancy. Once your employer has selected you for redundancy and served notice, if you want to leave early you may be able to agree this with them, in which case you will still be entitled to redundancy pay. However, if you leave early without your employer's agreement, you will lose your right to redundancy pay.

If you are offered the new role and reject it, you may lose the right to a redundancy payment.

If you are bring ringfenced for a new role, what makes you think you'll be made redundant? You're being redeployed..

If they offer you something else, you will not likely be offered redundancy.

I would ask to be considered for voluntary redundancy if you think this will be the case.

I assume that if I don’t pass the ring fence interview I’d then be let go? If they wanted to keep me, wouldn’t they do everything they could to job match instead of ring fence? Quite happy to be corrected as maybe it doesn’t work like that. It’s a small restructure - maybe 10 people affected in total.

If you are being ring fenced for another job, that sounds to me like they are going to offer you the other job, not make you redundant. There may be no need for a selection interview. However, if there is a selection interview and you fail it, you would then potentially be redundant unless they could offer you a suitable alternative.

They won’t necessarily ask you to interview, they might just redeploy you.

Are you the poster who has another job offer on the table? Are you hoping to match the redundancy dates with starting the new role?

I was redeployed last time they restructured. Apparently this time the job is too different to do a straight transfer in. Hence this ring fencing.

I don’t have a confirmed offer of another job as in signed anything, but there is an iron in the fire so to speak. Yes I do want redundancy if possible.

@DrMarciaFieldstone yes would love to coordinate dates - am aware it might not happen though. Would hate to resign then miss out on getting an at risk letter 3 days later!
