When you return to work? After half pay if you are still off it will go to zero and you may be assessed on capability or retired. If you mean you go off and return there may be contract that resets it after 12 months for example , so you can't be off for six months on full pay, return for a month then go off again on full pay.

I went off in April and returned phased in August returned full time in January and going off sick again.. Just trying to work out my finances.

Contract doesn't actually state the reset period.

I would think you have one month left of full pay then will move to half pay.

My employer has the allowance across two years from the date you are first off sick.

It really depends on your sickness policy - it may be in a rolling 12m period or a total 'forever'... nobody here can answer this without reading your company policy

Contract doesn't actually state the reset period.

Your contact isn't what you think it is. It includes all the policies, which is what you have to check. Unless your LA contract is non- standard, it should be a rolling 12 months period. That means that any sick pay paid within the previous 12 months is counted towards the calculations. And your phased return may partially count, depending on the hours you worked. You won't work it out with random strangers. You need to talk to your manager / union.

And I don't want to create anxiety - you probably know this anyway, but I'll have to say it just in case - talk to your union about capability/ sickness absence, because what you are describing here is way beyond trigger points. Are we talking disability? What are your prospects for a full return to work? If you are incapable of working, is there any possibility of incapacity or early retirement?

That's a lot of sick leave, and you need to get ahead of the conversation to protect your position.

It is likely to be a rolling period - in my old agency it was across a 3yr period. You'll need to ask about the local policy.

Thanks all. Unfortunately no HR to speak of - SE modelled on LA contracts. Will be rolling 12 months..it's cancer - unlucky to be hit twice ...

I'm sorry to hear that. Please talk to them, they must have a HR function somewhere. In my old civil service agency and in the police, I saw long term sick pay negotiated for different cancers (separately for brain, liver and breast) on three occasions, with half pay paid for much longer than 6 months in all of the cases. One person subsequently sick health retired, the other two returned to work after treatments. No guarantees, but worth asking about.

Quveas · 10/05/2023 22:11

Sorry to hear the reason. I'm guessing that means a social enterprise? In which case the contract could say just about anything. But you need to know if the phased return is included in any way. I do think you need a conversation with them to clarify.

Thanks all, you've given me some thoughts to approach them with.
