Just reading another thread about holiday entitlement and was wondering... can a company refuse to give you your holiday entitlement? My company (retail) says that if you don't book your holiday by a certain time you just won't get it, you can't carry it over and you won't be paid in lieu iyswim. problem is a lot of weeks get 'closed' at the start of the year (school hols) and as it's run on first come first served (or more acurately friends and family of the person in charge of hols get first choice!) a lot of people try unsuccessfully several times to book hols and it takes a few weeks to find out you've been unsuccessful. The upshot is that everyone then piles in and tries to book time off Feb/March at the end of financial year which then also gets closed! The added problem is that new staff who arrive late in the holiday year can also lose out...
Are they allowed to do this?! I often wonder but I've been on maternity leave, have just returned and received my holiday forms!

No they can't do this, you must get your holiday entitlement. If your company won't let you take it when you want they must tell you when you can take it.

thanks flowery, I thought as much but I never looked into it before I left on mat leave! one of the mums at school left a few months ago and they wouldn't give her any outstanding holiday pay, don't think that's right either!? I don't think any of the company's actions get questioned because they are such a big company so people think they do things by the book. I'm only after my treatment prior to mat leave last time and my treatment now I'm back and pg again!

No the holiday pay thing is not right either, if she left and had accrued holiday which she had not been able to take, she should have been paid for it.

Being a bit aware of your rights is no bad thing, and sadly lots of companies rely on the fact that many are not and assume they must be doing the right thing.

I know, it is pathetic that such a large company with huge profits is trying to cheat staff out of holiday they've earned!
