Resign? HELP

Hi all,

Asking for my husband he's currently working at the moment been in the job just short of 1 year and the hours have not suited and been offered another job but they want him to start on Friday training and told him if he wants the job he would have to resign from his job! So obviously that's not good as he needs to work his 2 weeks notice this new job sounds desperate to me like why wouldn't they wait for him to finish his notice they are so keen. It's for a milkman job by the way.

My question is if he did just resign would he get into trouble and not pay money he's owned?

Has he got any time owing or annual leave to use up? The two weeks notice is likely contractual and therefore he is obligated to work it. At some places, in some incidents, it can be waved at the discretion of HR.
Best bet would just be to tell the new role "unfortunately I am unable to start on that date due to my notice period, but I can start on x date" and see what they come back with.

They're a company too and shouldn't be expecting him to break contract to fill their spot when they dictate. In the same way they'd expect him to fulfil his contractual duties to them.

If they push and said he HAS to start Friday I'd be running a mile. It's a red flag to me that they'd want him doing this.

Also worth noting the company could potentially sue him for breach of contract. Unlikely, sure. But not impossible and they'd be within their right. If he started the new job and hated it and wanted to move on, my guess is no one would touch him with a breach of contract.. something they'd find out when it came to references.

So essentially no, he really shouldn't just resign with no notice. And the inevitable lack of pay is probably the least of the reasons!

Exactly what we have been thinking I said the same thing is a red flag as to how desperate they are is it cause they can't keep staff etc
and to ask him to resign when there a company themselves is shocking.

If they're asking him to break his contract with his other work I'd absolutely run a mile.

If they are desperate enough to ask a worker to do this, my bet is that they're not retaining staff. Which probably means it's bloody awful. If he did this he will be trapped there because even after dealing with the fallout of resigning without notice, he won't get a good reference from them for a new role.

Any business looking at a worker who'd done this would run a mile.

Best advice would be to not get trapped in this new job by burning his bridges. Of course he could ask his manager if they can come to an agreement about notice period, or he could ask the new people to wait. But I'd 10000% say no to breaking contract for them!
