Hi

My DH found was offered a new job and emailed his current employer on the 23 March 2023 his 4 weeks notice to end his employment on the 23 April 2023. He gave his notice using his work email and sent it to HR and his manager.

He has just received his end of employment documents stating his employment ended on the 24 March 2023. He has no access to his work emails or his work platform as his access has been revoked. We can not access the resignation email but are 100% sure there was no mistake in the dates or months - plus he is contracted to give 4 weeks notice.

We are really confused and don’t know what to do. We are assuming this is a HR mistake but is it easily corrected as if not my DH’s employment has ended without any notice from his employer and he will basically be unemployed for the next 4 weeks which has financial implications.

Does anyone have any advice on what we can do or have you been through anything similar.

My DH has emailed his manager using his personal email asking for clarification and has copied in HR. Hoping she calls him or emails him if she is in tomorrow. DH’s next shift was due to be on Wednesday.

If his contract states 4 weeks notice then he's entitled to 4 weeks notice. That would usually mean working the notice period, but it's also possible for a company to pay in lieu of notice. Your DH will need to clarify with his manager if that's what they've done.

Is he very senior that he's been placed on garden leave?

Is he moving to work for a competitor? Sometimes companies will pay in lieu of notice as they don't want employees spending 4 weeks gathering information to take with them to their new employer.

When I handed in my notice to move to what my employer thought was a competitor, I lost access to all systems immediately that day. They did pay me my notice period though. Definitely see what HR have to say. Notice periods are contractual so it doesn't matter how long he's worked there, he's entitled to what's in his contract.

He isn’t senior at all.

I know he is telling the truth as I proofread the email before he sent it.

He works for a supermarket chain right now based in the North of the country. He is now moving to a completely different sector after up-skilling through a privately funded course.

I honestly can’t see it being garden leave I genuinely think its a mistake from HR. He has messaged his manager who is also confused as to what has happened. DP has requested his resignation email is forwarded onto him for proof of his proposed employment end date.

UPDATE

He has had an email from HR stating this was a mistake which they are trying to undo. HR will be in touch once everything has been rectified.
