Maternity leave confusion

I would be grateful if anyone could help. I am due to go and chat to my employer next Monday to discuss everything.

I have been on maternity leave since 7th July and will be getting paid up until 7th April which is 39 weeks since I took maternity leave. I will not be returning to my job and want to resign.

My question is, in my resignation letter, do I put that I am resigning at the end of the full 52 weeks, in July? Would I still accumulate holiday pay from this? Or do I just put that I'm resigning on 7th April?

Thanks.

Yes you would accumulate annual leave for the whole time you are on maternity until the last day of your notice. So if you take the full 52 weeks including 13 weeks unpaid you accrue annual leave throughout that time until your last day of employment

Just give whatever notice period you have to give. If it’s a month then give your notice on 6th June etc.

Have you checked if you’ll need to pay back any mat pay if you don’t return?

SheilaFentiman · 06/03/2023 11:52

What is your notice period?

Yes you still accrue leave whilst employed.
if you aren’t leaving to go to another employer it would probably benefit you more financially to leave at the end of your maternity leave rather than end of your notice period. This is because when you leave you’ll be paid any unused and accrued holiday plus bank holidays if not already included in your usual holiday entitlement. Plus there’s lots of bank holidays coming up in April and May!

If you have to give a month's notice, wait until one month before you are due to return then give a month's notice so you get a whole year's holiday pay.

Hopefully your maternity cover will be enjoying the job and it will just be a case of offering them a permanent contract if that's what they would like with no need to go through the recruitment process to find a replacement.

What is your notice period?

1 weeks notice. It is a small family run food business but they haven't employed anyone to cover me.

I've just been paid weekly my Statutory Maternity Pay and they have been paying me any holiday built up every couple months. I don't think I have to pay them anything back?

If you have only had statutory MP, there shouldn’t be anything to pay back.

What is the purpose of the meeting you have set up? Are they currently expecting you to return on 7 April,?

Just to discuss and for them to meet baby again. I thought I'd have to hand my notice in but apparently not now until July. Wish I hadn't said yes to a meeting now haha. I'll just say I'm taking the full year off.
I will then hand my notice in at the end of June. Thanks for your help.
