I've recently accepted a new job, I have just resigned & am about to start working my notice. I have a few days annual leave to take & was planning to take it for the last few days of my employment so that I can leave my job earlier. I dont need the annual leave to do anything or go anywhere.
The team I'm moving to are desperate for me to start ASAP, so I've said I'll start during my annual leave.
Will I be doing anything wrong if I do this? I just want to start the new role ASAP. Does anyone have HR knowledge and know if this is OK?

you can’t do this - if you are on annual leave you are still contracted to your old employer

if you are that desperate to join your nee firm you could ask your old employer to let you go early if you forgot your holiday pay

I had a similar situation but my old employer wouldn’t let me take those last few days as annual leave and made me take them when it suited them instead 😔

how will they know?

ive had two jobs previously and taken annual leave to do a course for the other job.

Congratulations on your new job! Unless your contract states anything about it, it's a myth that you can't have two jobs at once. However to avoid any complications with tax you might want to ask your manager if you can leave on your last working day and they pay you your holiday as a lump sum rather than you take it. That will bring your last day of service forward, and it costs them no more money (in fact it would be less as you won't receive benefits or accrue holiday during those few days). Just might want to check that payroll hasn't closed already.

Yes you can. I used a week and a half annual leave to start my new job.

OP just put in the annual leave request.

You don’t even know if you will be allowed to take the annual leave yet. Even if you are, you would need to check with your employer whether they permit you to take a second job, many employers would not.

Do what you want OP and tell them what you plan to do. How can they really stop you? There’s nothing employers can really do in these situations short of suing you which HR are not going to do.

@Allboundformoomooland this is great advice.

if you can’t get current to let you finish early and pay out your holiday then I would let the HR team know in your new job just as a courtesy what you are planning to do.

be very careful also as you don’t have a right to take your holiday - if current employer decides to they could make you work your notice and pay out the unused vacation at the end.

to get round this, sweet talk your manager and talk about motivation levels and how you’d find it much better to hand over to the team in a short and condensed period than drag it out for a month when you have vacation owed and feel quite tired.

Thanks for the advice everyone. My current employers are more than happy for me to take my annual leave as part of my notice period as I've worked above & beyond for them & am leaving amicably. I just wanted to double check that starting a new role whilst technically on annual leave is ok to do as my leave & start dates will technically overlap. I'll check my contract too
