Hello,

I have been with the nhs since 2014, up until July 2022 where I went to work somewhere else until jan 2023 where I am back at the nhs in my old job. Will I be entiltied to Nhs occ pay or not? Or when would I be entitled to it as me and my partner want to ttc soon but want the occ maternity pay :)

I understand it has to be a year of continuous employment to qualify and then you have to go back for a minimum of 3 months after maternity leave.

You would be better to look at your local trust policy though.

To receive OMP, an employee must satisfy the notification criteria in paragraph 49 and;
66.1. Have 12 months continuous NHS service (see toolkit for guidance) with one or more NHS employers at the beginning of the 11th week before the EWC; and
66.2. Intend to return to work for the same or another NHS employer for at least three months after their maternity leave has ended.
this is what my policy says but unsure of it.

If you worked somewhere else non NHS in last six months your service is not continuous.

So you need to wait approx six months before ttc.

@Jemima1290 basic maths you re-joined NHS on ??/01/23 add 52.2 weeks = ??/01/24 add 12 weeks (11 + EWC) = xx/xx/24 deduct 40 weeks = xx/xx/23 once you reach this date to be safe have your next period then TTC and you will meet criteria 66.1 .

You need to google agenda for change t&cs and check what counts as continuous service for mat leave purposes.

I think you can only have a break of 3 months unfortunately, but have a look yourself just to double check that applies to your circumstances.

I had the exact same happen to me.
you need to have worked in the trust for a year by the time you are 29 weeks pregnant (11 weeks before expected week of confinement)

I got pregnant on first try so mine was perfectly planned by a week over lol

This is not true is you are moving from one NHS trust to another. I moved roles when already pregnant and qualified for full OMP in my new role because I had >10 years continuous NHS service.

In OP's case, the break in service means she does need to wait

It was possibly SMP I had to wait for then. I remember checking with HR and I had to wait to qualify for one of them even though I’d been an nhs employee for 13 years continuously.

Sorry it has took me a while to reply so I started back on the 31st jan 2023 so basically need to be 29 weeks to qualify for occupational maternity pay?? Am I correct? X

You need to have worked within the NHS for 1 year by the time you hit 29 weeks pregnant to qualify
