Hello,

Looking for some help as I think my employer has worked out my annual leave entitlement wrong.

I currently work 32 hours a week doing compressed shifts of 8 hours over 4 days.

Normal full time hours are 35 hours per week with 5 x 7 hour days.

My contact states "you are entitled to 38 days pays holiday each year (inclusive of 5 public holidays) with this increasing to 41 days paid holiday each year after 5 years service"

I have worked with the company for over 8 years, so I am entitled to extra, but I know that due to being part time, I won't be entitled to all of them.

They've worked it out that after the 5 days public holiday, I am entitled to 27 days holidays

Can someone who understands this advice if this is correct?

As its based on days worked and not hours, I believe it should be 28. Only because before the bank holidays the pro-rata would be 32.8 days and you cannot round down holiday days. They don't have to necessarily round it up to 33 but they can't do you out of part of a day.

My calculations are that you are entitled to 32 day, so 27 plus 5 bank hols seems correct.

It sounds like a lot less because they are longer day, I think?

In hours, ful time get 287 hours and you get 261.

I also make it 28 days. Well, actually 27.8 but rounded up.

I make it 32.8 days including the 5 days bank hols, so 27.8 after, so I think your employer is short changing you by 0.8 of a day.

41 days x a normal 7 hour day = 287 hours per year is the full time allowance

287 hours divided by 35 and times by 32 = 262.4 hours per year is your allowance

262.4 divided by your 8 hour working day = 32.8 days

btw are you in the UK? Because there’s usually 8 days bank holiday in England - have they done you out of bank holidays too?

WT - 35x 7 = 266 hours

PT 266/35*32 = 224 hrs

224/8 (your working hours) = 28 days

A way I always check it to check both are same in working weeks.

So 35 divided by 5 is 7 weeks.

28 days divided by 4 is 7 weeks.

So you and WT are getting the equivalent of 7 paid weeks off work.

Sorry, I was using the wrong figures!

42 days * 7 hrs = 287 hours

Pro rata 32 hrs is 262.4 or 32.8 days. We would usually round up to nearest half day so would give you 33 days.

WT gets 8.2 weeks (41/5)
You should also get 8.2 weeks (32.8/4).

Is it possible the 28 are you annual leave and the difference of 5 are back holidays and they will give them separately?

Usually it's the other way round. Part timers get BH included in entitlement as they might not work on the BH but whole timers won't need to as they would be off.
