Holidays & Bank holidays - part time

BHMaThs · 03/01/2023 17:12

Please help me get my head around this!

If I work 3 days a week and get 20 hours prorata holiday - I don't work Wednesdays or Thursdays.

How do I work out what of my holiday has to be taken on bank holidays (when business is closed).

We have a few part time workers (incl me) in our team and our HR dept work our entitlement out each year. As it differs depending which days people work.

This may or may not make sense how I explain it... 😂

I work 3 days Tues, Weds and Thurs and get 12 days basic hol (pro rata of 20) then 5/8 bank holidays.
But then out of this I get a day taken off for each time a BH falls on one of my working days and I get it off. With the days I work it's usually just 1 or 2 depending how Xmas falls.

The rest I get as additional annual leave to take as I want! So I usually get an extra 3 or 4 days to book on top of my 12.

I purposely didn't choose a Monday to work so I could pick the bank hol lieu days I have off!

I don't get why you have a day taken off for each bank holiday?

You have to take your standard hours for the day off. It will seem disproportionate because you work a third of your week in one day.

BHMaThs · 03/01/2023 18:21

I feel really stupid sorry. I'm just not getting it. I'm trying to do a worked example with basic figures but I can't do it! Feel so dumb.

If you work a 3 day week your total entitlement is 16.8 days which generally include bank holidays.
There are 8 bank holidays this year plus 1 extra for the kings coronation.
So of 16.8 days total entitlement you have all 8 bank holidays and 8.8 regular annual leave holiday days.
The treatment of the extra bank holiday will be determined by your contract of employment. If it says 20 days plus bank holidays (pro rata) then you will get this extra day too. If it says 28 days including bank holidays (pro rata) then you will either have to ask if you get it or if you have to take one from your 8.8 regular annual leave days to cover it.
You don’t work Wednesday or Thursday and no bank holidays fall on those days (this year) so ignore that.

The only other thing to consider is where in the company leave calendar you are. Example, their leave calendar may run April to March and if you’ve just started work today your entitlement will be calculated from now to 31st March so won’t be full entitlement until the new leave year starts again in April etc

I guess because I'm getting a day off for it? As another poster says tho, no bank hols fall on your days off so I assume you won't get any additional leave you will just get the bank hols off, as they fall on your working days anyway?

Last year I got extra half day for the jubilee bank hol so I think I'll get the same again this year. My total BH entitlement is actually 4.8 days I think but my company round up to 5 days.

It will be different for you as you work different days, sorry to confuse you ☺

@BHMaThs You are paid to work Mondays so when a Bank Holiday falls on a Monday you don’t work the Monday but are still paid. So you lose one days paid leave from you entitlement for each Bank Holiday falling on your working day.

Curlysusie · 03/01/2023 19:11

I believe if you work 60% you get 60% allocation of bank holidays therefore have to top up the bank holiday with a few annual leave hours

Oh.

Yes. That makes sense. So even though others get all the holidays off I have to use some of my holiday to cover the bank holidays? Because I only get pro rata bank holidays.

I wish they weren't all Mondays 😭

Others explained it a lot better than me!

Yes this is an issue tho with working Mondays part time. One of my colleagues has to use some of her annual leave to cover the bank hols as she's only entitled to 60% and they mostly fall on the days she works (and the office is closed so she has to be off).

Have you tried asking to change your working days e.g. Tuesday, Wednesday Friday or Tuesday Thursday Friday?

Yes it was a flexible working request and those options were rejected

27 days annual leave plus 8 bank holidays pro rata to 3 days a week is 3/5 of 35 days total, 25 days. If a bank holiday is on my working day it gets deducted.
