I have just started a new employed role working 3 days a week. I do not work mondays.

I have been given a pro rata allowance of hours for bank holidays. I have then been deducted 4.8 hours for each bank holiday, including ones that fall on non-working days. So I'm 'spending' 38.4 hours leave, but only getting 16 hours time off for it.

Does that seem fair or right?

You should get â…— of the full time allowance. Only the bank holidays that fall on your working days should be deducted.

What's the full time allowance and what hours/days do you work?

No, it doesn't seem right.

Pro-rata allowance of bank holidays - fine.
But then you should only have holiday deducted (presumably at 8hrs per day based on those figures) for the BH's that actually fall on your working days.

OP you need to actually say how many hours a week you are working to get a reply to this - is your 3 x days per week 7.5 hours a day so 22.5 hours per week???

I get 3/5ths of the full time bank holiday allowance, then I'm deducted 3/5ths of all bank holidays, whether they are on my working days or not.

I work three 8 hour days - weds, thurs, fri.

I'm no expert but no this doesn't seem right. Unless your holiday is plus's bank holiday , if your holiday includes bank holidays then it's not fair as your can't book a day off you don't work .

If full timers get 5.6 weeks/28 days holidays then you should get 5.6 x 24 = 134.4 hours. Deduct any bank holidays that fall on working days to give the holidays you can choose yourself

You would get 3/5 of the bank holiday hours but you need to take the number of hours off that you work on a particular day. So 8 hours per bank hol that falls on a day you work. But no hours if it falls on a day you don’t work. That’s what we do where I work anyway! I get 4 hours per bank hol but take 5 as I do a 5 hour day.

My contract gives my annual leave, and then says I will have a 'pro rata entitlement to the usual bank holidays'

I work in HR - as you work 0.6 we would add 0.6x8 hours for each bank holiday, so 4.8 is about right, but we would then deduct 8 hours for each bank holiday that falls on your working day - as you work an 8 hour day and need to be paid for all of it. So for 2023 you would have 43.2 hours added for pro rats bank holidays, and as there’s only one bank holiday that falls on your working day (Good Friday) 8 hours deducted. Definitely ask them to have another look

I’ve always found writing the full calculation out in hours helps make the point to HR.

So full time ? days x 7.5 hours = ? Hours
part time hours x 0.6 = ? Hours gross leave

less BH falling on working days
NYD (Mon) = 0 hours
GF (Fri) = 0 hours or 7.5 not sure if you work Fridays etc.
EM (Mon) = O hours
etc.

Total up and deduct from gross leave = net leave.

Point out you get paid nil hours on a Monday so they can’t deduct anything from that.

@Motorina each organisation is free to work out annual leave however they like, and there are variations on it, but employment law states that part time employees must not be disadvantaged in comparison to full time - if you are having bank holiday time deducted from your non working day this would definitely count as a disadvantage, it’s equivalent to taking a full timers annual leave for their weekend days off.

I agree with @Princessglittery put it in writing to HR and demonstrate why you think it’s incorrect. Lust which bank hols fall on your working days and what the actual working time is for that day, you should only have to use your credited bank holiday hours for the actual time you would be working. X

I have a sneaking suspicion, having dug deeper, that my leave has been set up on the basis I'm working 5 short days (not 3 normal ones), which would explain why they've calculated it as it is. I've sent an email to HR but, unsurprisingly, noone is in til next week.

5 short days would explain a deduction of 38.6 hols for bank holidays (I’m assuming they only count the 8 regular ones and wouldn’t pay for additional ones like the Coronation etc)
