DH got a new job, last job hasn’t paid him

He worked his notice and he received his final payslip which looked fine and it stated he would be paid on a specific date two weeks ago. Nothing came.

Normally he would be paid today, monthly, had he stayed. Nothing today either.

They haven’t been very helpful since he worked his notice. They refused to give a reference because they felt he hadn’t worked there long enough (since April) . Thankfully his new employer has had the measure of the company already and this isn’t unexpected, as they are rival companies .

What is the best way to tackle this, as the company haven’t treated him very well hence him leaving ? DH understandably pissed off so I don’t want him to go in all guns blazing 🫣

Contact ACAS and start a claim for unlawful deductions.

Contact payroll in the first instance. He can't raise a dispute yet until he understand why he hasn't been paid.

There coyld be legimate reasons for nkn payment such as he took extra holiday. However he should get final payslip with deductions.

Write/email his manager and cc in payroll and HR Director. Give them 14 calendar days to pay his salary. State he will claim for any financial detriment as a result of unlawful deduction of wages. If not paid in 14 days send a letter before action (Google templates) giving them a further 14 calendar days then make a small claims application.

Ideally set out gross pay he is due along with holiday pay etc.

@Livinghappy if they have issued a payslip then they must have run payroll so are withholding his payment.

Issue a statutory demand to employer. This gives them 2 weeks to pay or you will bankrupt them .

@Princessglittery why would you make a small claim (and incur a fee) when you could get an early conciliation certificate from ACAS and issue an employment tribunal claim (if needed) for free?

OP agree with contacting payroll/HR in the first instance but don't delay with further action if necessary because tribunals have strict and short time limits.

@lawandgin good point, I am used to doing it the other way I.e. employee leaves owing an employer and on behalf of the employer I would issue the letter before action.
