Starting new job but can't provide a p45 - what happens

Honestly not asking for me but for a friend who is now having a panic.

They have been unemployed, have been applying for jobs as if they were still employed as thought it would improve their chances.

They have now been offered a job - the reference side of things isn't an issue. But they have no p45, they have no p60. They haven't worked in a few years. Are the new employer likely to rumble them?

As in they have lied about being employed and about experience or just didn't say they are unemployed?

If you don't have either of those forms you can complete a declaration as to whether this is your first job this financial year. It is unlikely payroll and hr crosscheck information given. However lying on a cv may come back to bite her. Why is she not being honest?

They will have to sign a new starter form (used to be a P46) where they tick whether they have had a job in this financial year or not to get the correct tax code so they may become unstuck if they have not worked since April as that is a different box to tick.

It’s not a problem or unusual for somebody not to have a P45. Old employers can be slow to issue them.

Obviously the lying isn’t great and is something that’s going to bother her even if it’s not uncovered. I can see why she’s done it though if she thinks an employment gap has been preventing her getting a job.

If she's been saying she's employed when she's not, what's she doing about references? the P45 is a bit of a non-issue, employer will probably put her on emergency tax, but lying on a CV? not a good look.

Your friend needs to complete a form from HMRC called a New Starter Checklist. I think it used to be called a P46.

It can be done online and then you save it as a PDF and send it to the employer

It is quite common not to have a P45 ready to hand out to your new employer.

I left a job this week and will start a new one straight away next week. The payroll team in the job I just left will only be able to give me a P45 next month so I provided my new employer with the form I mentioned instead.

Nope.

I started with a dodgy company who lied to HRMC about being 1 week later then starting, (I have no idea at the time and it didn't come out until after I'd left dodgy company) only this week had they changed an end of day of payroll date from 5th April 2023 to 30th June 2022 so the owner scum of the earth could get another week unpaid under their belt. But he certainly lead HRMC on for weeks.

He is the scum of this earth.
