Holiday owing and notice period

Hi,

I handed my notice in on Wednesday of this week (23rd). My notice period is 4 weeks, which makes my leaving date 19th Feb. However I haven't taken any hol this year, and based on 25 days annual hol a year, I think this means I have 3 days owing.
I have told my manager in a letter that I would like the 15th Feb to be my last day and 18-20th I will take from my 3 days holiday owing. She has said she would like me to work the full 4 weeks.... It doesn't say anything in my contract about holiday during notice period and I was never issued an employee handbook....

Really would like to leave on 15th and have a week off before I start my new job. Any advice would be welcome. Sorry for the long post x

Cosmo as long as you get paid what you are owed there is nothing that says your employer must let you take holiday when you request it, she is perfectly within her rights to not allow you to take holiday during your notice period if it is inconvenient for her.

FBB is entirely right, but make sure you get paid for the holiday you are owed. Might be worth making sure your manager knows you will have to be paid for it if you don't take it. I think I'm right in saying they have to pay for it if you don't take it, aren't I?

Bummer.... Thanks Flowery. Given that I told her on the 23rd and gave her the letter on 24th, am I correct in saying 19th would be the day I can escape?

Hopefully -yes they must pay it with final salary payment if it's not taken.

Cosmo 19th if she takes the 4 weeks from 23rd, 20th if notice started on receipt of written notice.

Only thing to mention about that is that your reference may not be quite as glowing if your boss thinks you were swinging the lead...

She not a he!....but I have too much of a guilty conscience to do that. I'm just hoping she'll see my way of thinking. What is the point in coming in for 2 days...I may as well finish up on the Friday. I think that she is on holiday the week of the 18th too. Bit odd, but we are going to 'talk' Monday....can hardly wait! She said in a email she is still coming to terms with the fact I am going and hadn't really looked at the date on my letter!...
