Boss won't fill out my verification background check

My boss is a dick and she likes to think she can control people, infact she gets a kick out of it. I have returned from maternity leave in April and have been looking at other opportunities. I finally found one and got offered the job subject to background check. Problem is They have emailed my boss who won't fill out the form for me. It's a small company with no HR ( I actually gave the number of the girls that does our HR stuff to the hiring people but the have contact my boss) what can I do? She wants me to stay and is ignoring the emails from them asking for my details. They are going to pull the offer aren t they! It's gonna look like a red flag and I don't know what to do

What an utter jerk. First, do as PP suggested and print or email to yourself any evidence you have of how long you've worked there.

Then go over to your boss' desk, or into her office or whatever, and say "excuse me X, sorry to bother you, but that background check form has to be completed today, can you please do it now, I'll stay here while you do it and give you the information to speed up the process". And DO NOT LEAVE until she does it. If she says she'll do it later, say that you are happy to wait and just keep standing there next to her. If other employees can hear you, so much the better.

If she says that she is not going to do it, ask her to forward the link to the women who does HR so she can do it on her behalf. If she refuses to do that to, look her in the eye and say "Why? Are you really the sort of person who would try to destroy someone else's chances of getting a job she wants?"

I know that's super scary, but you have to stand up for yourself. If none of that works, call the new employer and explain that they sent the forms to the company owner who won't fill them in as she doesn't want you to leave, but you can provide other evidence of employment and/or they can talk to the HR person.

I think you need to stop panicking, stop nearly crying and act professionally and take control of this situation.
Contact the new employer and tell them that your boss is unable to complete the form, so would they prefer to contact the HR number you provided, or would they like you to provide them with another reference.
It is against the law to give a false reference so your boss would be foolish to give you a bad reference if they call her.

Have you got the original offer letter and some payslips? Or bank statements?

Would recent payslips help? At least with the pay aspect. Do you have a contract to show your job title?

@Elisheva thanks for helping. My only issue is it's a 3rd party doing it on behalf of employer so she might not necessarily take anything to do with it until the report comes back from screening company. I'm just worried that whatever I do/don't do it'll be the wrong thing and set me off on a bad foot. Like who would ever dream this situation up?!?

Well yes but you could resolve it yourself with the initial letter and payslips.

I also agree with another PP who suggested that you send your initial offer letter (or contract, if you have one) to the new company, together with pay slips and/or tax statements.

But above all, calm down and act professionally.

I have work in recruitment. When we can't get a reference we would ask for tax records.
I would explain the situation to your new employer. Tell them you are more than happy for them to keep contacting her/ go to HR and you will also provide them with payslips/tax records.

This. If you were rubbish at your job they'd be sending it back return of post in order to get rid of you.

@FlowerArranger I know it appears silly, I get that but it's different when your hopes are dependent on someone else beyond your control.

I have spoken to a few people and they have said to wait until the screening company get back and ask for more info. I don't really want to draw attention to the HR person that I'll be working with on a daily basis.

It's not against the law to give a false reference! I do wish mumsnetters would stop suggesting everything is "against the law" ie criminal. Do you really think that there's a crime if someone does that?

You may have a claim in civil law (I think the relevant case was called Spring) but the police aren't going to turn up with handcuffs.

Yes it is. It’s not against the law to give a bad reference, if that reference is accurate. Employers are not allowed to give false, inaccurate or misleading references and if they do you can take legal action against them.

I was in a similar situation. I changed my name after leaving one employee so they refused a reference as the didn’t have a record for my new name which bc was ridiculous. I provided my starting letter, contract, p45 and letter confirming my leaving date. They had asked for certain payslips or a bank statement for about 10 years ago which i didn’t have 🙄. They accepted the alternative details as it proved my date of employment, salary and job title.

I had a similar issue with one of my ex-companies I worked for, the background checking agents couldn't get any reference from them, I emailed asking as well no response so they told me if I could provide proof of employment so I gave them payslip copies, P45 etc they were acceptable documents
