Funeral bank holiday, non Monday workers

For those of you who do not work Monday, did your employer give you another day off, like your Monday working colleagues ?

Everyone full time got a paid day off. Everyone part time did not.
That means the FTers were treated more favourably.

It doesn't sound like that's the case. It sounds like everyone who works Mondays got the day off, so any part time staff who work Mondays got the day off too, therefore weren't treated unfavourably because they're part time.

Usually part time workers get the bank holidays pro rated. Because this was a special one and no government mandate for everyone to get time off our company took the approach that you got your Monday contracted hours off. So for me that worked well because I work all day Monday and half days other days so if it had been pro rated as usual I'd have only got 5.25 hrs but instead I got the whole day. If Monday is your usual day off then you don't get anything.

For those that "miss out on BHs" - are you permanent staff? Are you full time or part time? In England?

All staff on FT should get the 8 BHs. If you don't work Mondays contractually (and work sat or Sunday eg), then the 8 days should be added to your allowance to use another time.

All PT staff should get the pro rata amount of BHs to use either on BHs (if worked) or another time if not contracted a BH working day.

That is not true. There is no "should". Bank holidays - none of them - have any meaning in employment law. All employees are entitled to a minimum of 28 working days holiday a year if they full time, and pro-rata for part time workers. Beyond that legal entitlement everything is contractual. So if you only get 28 days holiday, that may include bank holidays if the employer says it does. You may get XX days PLUS bank holidays (provided XX equals at least 20). Or you may bet 20 days plus 8 bank holidays in which case there is no entitlement to any extra bank holidays. Or any possible combination provided the term gives you at least 28 days leave every year.

So in terms of the additional bank holiday(s) this year, any entitlement would either be because contracts give that entitlement or because the employer has agreed to allow employees that extra day. But if, for example, the contract says 28 days leave to include bank holidays, then your number of "free" days when you can ask for leave at other times reduced to 18 this year because there have been 10 bank holidays.

So it is all down to the contract. If the employer gave it as a bank holiday then part-time staff should be treated on the same basis as anyone else. But if the employer simply decided to close, that is not the same thing as a holiday day, so anyone not working that day loses out.

No, we were given the day if we wanted to watch the funeral but the day cannot be transferred to another time. The view was the day was given to mark the Queen's funeral, if you were not going to do that then you should not take the day at another time.

Staff in my department, who don't normally work a Monday, have been given the day added on to their annual leave. In some ways I don't agree with it, as the day was specifically for the Queen's funeral and most of us will have used the day glued to the tv (I was) but then we can't treat other employees less favourably either.

For those of you who don't get the bank hols for not working a Monday - you should be! Get the union in if you have one. The days should be added to your leave allowance (pro-rata) for you to take another time. All workers are entitled to 8 bank holidays a year and any employers swindling staff out of them need hauling in front of a judge.
