NHS maternity pay : returning

Hi all,

Looking for some advice on this;

I have taken the year leave from the NHS,
I have the last 3 months unpaid.
I have annual leave to take (two months worth).
Can I take one month of the 3 ^ unpaid then ask to take my annual leave for the last 2?

I used my remaining leave as it meant I went back and was back rather than rushing to use up leave.
Be aware that your first wage will be lower than you think if you are opted in for pension as they take back what hasn’t been paid whilst on ML, I think it was 2 possibly 3 months until it was back to normal.

Thankyou for the heads up regarding pension

im just querying if I can take the one month unpaid then return using annual leave for last two months…

You can but it's up to them whether they agree. And those two months annual leave would be the first couple you'd see extra pension deductions against.

@findingsomeone thanks that’s useful to know

My understanding (I'm just about to go on NHS annual leave) is that you could either finish your maternity at 10 months and take the annual leave and come back to work at 12 months, or continue your maternity for the full 12 then take your annual leave after to give you 14 months off

Nejnej2 · 08/09/2022 18:16

About to go on maternity leave sorry!

Jam291 · 08/09/2022 18:19

@Nejnej2 ah ok!
im just trying to get some background information before speaking to my boss.

@2anddonefornow @findingsomeone
ive just checked payslips and I’ve paid my pension all the way through my Mat leave xx

At the same rate? They usually take a lot less pension once you go onto SMP but I guess it depends how much you pay

AndSoFinally · 08/09/2022 19:42

Also you wouldn't normally pay pension for the last 3 months as you don't get any pay to deduct it from

Jam291 · 08/09/2022 19:47

sorry. -lack of sleep yes reduced rate!

When you say you have 2 month's worth of annual leave, is that presumed accrued over the year off? As surely you will only be entitled to a full year's entitlement of annual leave if you take the whole year of maternity? My understanding was if you only took 10 months mat leave then you would only get 10 months annual leave pro rata? I could be wrong though! I would seek clarity with HR

Jam291 · 08/09/2022 20:02

@Ihatewinding
i had annual leave carried over from last year, with this years entitlement to.
(it’s all been worked out so I have 11 weeks to take) :)

Hi, slightly on topic, NHS maternity. I’m currently on maternity as a band 5 nurse. I am currently around 9 months in and planned to have the 52 weeks. I am now in a situation where I may not be able to go back due to childcare. I know I have to go back for three months in order to not have to pay back my maternity. I am owed 7 weeks annual leave. Does anyone offer some advice on how I can remain off for the full three months that the NHS states in the contract. But not have to pay back maternity? Thanks. Hope this makes sense.

Princessglittery · 11/01/2023 12:45

@Jam291 Pp are right your accrued leave maybe based on 12 months Mat leave so if you start leave after 10 months you might get less leave. Another option is to use your leave to phase back into work e.g. working 3 days rather than 5 or less shifts.
