Not been paid 🥺

Does anybody have any experience of their employer not being able to pay their monthly salary?

We have been informed that we most probably will not receive any wage tomorrow due to non-payments from various clients and I am feeling sick with anxiety right now 😒😥 I am a single mum of 3, nobody to help financially and my (very) small proportion of UC is not due until 12th August 🥹🥺

I have made a start in raising a claim with ACAS but have been made aware that this can be a lengthy process; I currently have around £50 in my account to last until 12th August 😢

Any suggestions or advice would be greatly appreciated 🙏

Call the council/dwp and ask for a crisis grant they can give money for food electric etc in these circumstances

I’m pretty sure your employer can’t not pay you!

They can't not pay you!

Your UC would be worked out by your pay slip? No?

How much did your employer put through to HMRC as that's why they base it off. So if your statement isn't ready yet and they go off of £0 you should be entitled to more x

Can you get a referral to a food bank to tide you over until it's sorted?

Bigwetdog · 28/07/2022 13:56

Op this is awful, I'm sorry. I don't have legal advice but a practical step would be to stop any payments due to go out that you can't afford - and tell those you owe money to it will be late. Tell them why. Try a food bank referral and crisis loan after that

Obviously the employer can't legally not pay you. But if they haven't got the money, then it's going to take several weeks at best (and probably a lot longer) to get it through legal action. If you ever do get it.

Speak to the DWP about your UC, and use an advice service to find out about any local help.

Then start looking for another job because if the company is this close to the wire, it's probably only a matter of time before it goes under.

Of course they can. The person in payroll can’t send money which they don’t have.

I'm so sorry you're in this situation op but if the business is insolvent and they don't have the money then yes, they can legitimately not pay you. What they CAN'T do is carry on trading and asking staff to carry on working to pretend they CAN pay their bills to potential clients.

As pp have said, there are protections for you.

Crisis and care award from local council.

Budgeting advance unlikely from UC if you’ve earned more than £2600 in last six months.

UC will of course adjust the payment due on 12th August but that doesn’t help you now.
