AIBU to ask for paid holiday due to wages being short-changed AGAIN.

AIBU to send a message to my manager to say I want paid holiday for this week because I am completely deflated and depressed due to the fact that they have short changed me again on my wages. The last time was about 2 months ago and no resolution yet and 3 months ago a payment was missed completely

When I saw my payslip last Thursday, I saw lesser money and I raised the issue with my manager and asked her for paid holiday because I could not just work - I felt broken and the wages are now in my account and of course not the correct amount and the reality has hit me again now and I am broken because I have to buy food for the kids and bills to pay.
I have just sent a griviance letter to HR but I am not expecting much from if because the firm is just completely useless and the lack of transparency is unbelievable.

I will be well justified to refuse to work under this condition and ask for a paid holiday because I can't deliver my best and work effectively feeling depressed like this. Right?

I don’t think the paid holiday thing is the real issue here. You’ve had one missed pay check and two short ones in the last quarter. Have you had an explanation?

They’re not paying you, so it’s fine not to work.

I’d be looking for a new job.

Do you work for Next? They are having massive problems with their new payroll software and a lot of people are being underpaid.

They might not pay you for the holiday though, if they aren't paying you correctly anyway.

I'd be having a look online at employment rights etc, starting with ACAS. Then calling HR to demand a resolution ASAP.

Is this a company wide problem or just you?

Even if it was a payroll software issue, they have the ability to immediately transfer you the outstanding amount via BACS, so I would be pushing this hard and threatening them with tribunal for unlawful deduction of wages. Amazing how those words suddenly light a fire under their arse and miraculously shit gets done.

Of course you should have paid holidays, are they logged and approved via a system?

They need to explain the discrepancies and pay you for any outstanding wages, are you in a union?

There are two things going on here, and while they are linked, I think you need to tackle them separately.

Being under paid is NOT OK. They need to sort that out ASAP, and get you your full wages every pay date.

Feeling overwhelmed and unable to work is also OK. Can you have sick leave? And would taking annual leave now leave you short later in the year?

Tricky situation. They do sound like an unscrupulous company. Paid holiday isn't quite what you should be asking for. Well, it might work!

If your employer has made a genuine mistake, just ask them to pay you the money you’re owed straight away. You shouldn’t have to wait until your next pay day.
Advise manager that you can't do any more shifts until the payroll issue is resolved. Maybe it will make manager action or more speedily.

Alternatively, this could leave you with no work, no earnings. Are you sure you can cope with that? Threatening to not work is tricky for you, because of vulnerability.

I was wondering how you got on, as your last thread had the know it all payroll person. You had good advice from HMRC which you shared with your employer. Glad to see you have lodged a grievance.

You are being made unwell by this situation so either contact your GP or self certify sick with work related stress and anxiety due to being repeatedly underpaid.

Talk to ACAS about unlawful deduction of wages and starting an early conciliation. I would also consider a formal complaint to HMRC and ICO about your employer providing inaccurate data as HMRC submissions do not correlate to your wage slips.

Sadly this will take time to resolve but their unreasonable responses and no guarantee you will be paid correctly are already impacting your health so taking action asap is the best way to get this resolved.

So manager said the planning dept has refused my request for paid holiday saying there isn't any holiday left (I am not surprised) they have acknowledged my grievance letter & my manager called me yesterday and said she passed on the amount owed to me to payroll for payment. I emailed payroll early this morning to say I am expecting the pay in my account latest tomorrow morning Thursday otherwise, I will add unlawful deduction of wages to the list of issues I am taking to the employment tribunal & that I will requesting compensation as their action is giving me anxiety, panic attacks etc.
I also wrote in the grievance letter that I would like to attend meeting accompanied by a friend or a trade union representative.
I have also filled a sick note form at my GP today saying that my panic attacks and anxiety started last week Monday.

Hello all and thanks to everyone who commented - all very much appreciated

Now I have written a grievance letter to HR threatening them with employment tribunal and that I will be pressing for compensation for all the inconveniences as a result of unlawful deduction of wages. They have replied asking to speak to me 1st informally and I have accepted to speak to the HR personnel.

Any tips on what to say?
I will obviously be asking for money owed to me, I want a record of hours worked and paid for from the payroll system, HMRC income report corrected, holiday pay for the time I have taken off since last week due to the stress of being short-changed. They refused my holiday pay but I have doctors sick note.
suggestions, opinions will be appreciated thanks a bunch
