Hi

Is there anyone who could help me with a sexual harrasment grievance I have made against a manager who made a obscene comment in a team meeting towards myself. My grievance has been upheld but as they said it wasn't directed at me (it was 100% had he made eye contact whilst saying it). Does this have any relevance to the consequences? And should they have spoken to everyone who has made all the allegations about him Before?.
Thanks and sorry if that doesn't make much sense but anyone who any knowledge who could help me would be great.

In my experience HR would deal with your complaint independently and not go to others who have made a similar claim against an individual. Sometimes employees can come forward as a group but most of the time it is dealt with as a single case. However HR would be on alert if there is a pattern of behaviour emerging.

It would depend what was said exactly and what others in the investigation told HR with regards to consequences. He could be on a final written warning for example and he will be fired. It could be deemed not as bad as gross misconduct and other measures will be taken.

Sorry, that probably does not help much.

An employer can consider a pattern of behaviour as relevant - but they do not have to, and I would not expect them to speak to people who have previously made allegations. Those allegations should have been dealt with in the past so I wouldn't expect them to be brought to bear again. So if there was a record of upheld complaints that might inform the outcome of a subsequent one. But if there was no action taken, then no, I wouldn't expect them to rehash things that had already been dealt with.

I am not sure what you are really asking here though. You made a grievance and it has been upheld. What action is taken against him is down to the employer - it is not for you to decide what that is. So if you are looking to enforce a particular outcome that you want, that is not going to happen. Why are you really asking?

I also don’t really know what you are getting at. They have investigated your grievance and upheld it, that is the end of it for you. Even if there were previous incidents, there is no reason why they should talk to everybody again, they are surely only going to hear the same things again? If things like this happen regularly you can be sure that somebody will have noticed.
