Sick note and new job

Unsure what I should do

I got signed off work during my notice period because of workplace stress, I have my new job lined up to start soon but it starts before my sick note runs out.

Because I contacted them through e consult the Dr emailed the sick note through and I actually didn't speak to them to explain how long I needed.

I have only given the sick note to my current employer and not to my new employer as I do not intend on using it with the new employer.

The note itself states the Dr does not need to see me again and that I'm fine to go back to work without seeing the Dr again.

My MIL thinks I need to see the Dr again so I can be deamed fit to work for my new job as she thinks it will cause issues with insurance.

I think I'm fine to start the new job without speaking to the Dr again as my sick note is only relevant to my old position, new job is not going to put me in dangerous situations using equipment I'm not trained on in a lone working environment and therefore will not cause me workplace stress.

Does anyone know what I should do in this situation?

you don’t need to contact the doctor for another note or confirmation to go back to work after a sicknote has ended.

I am in a similar position my doctor gave me a note on Friday for stress at work. I have got a new job starting in a few weeks. But I don’t know how to give in my sicknote and notice as I only need to give a weeks notice And I want to get my full wage. Earliest I can give my notice is 25th may. But I want to give this sick note in tho. I just don’t know what to do tomorrow morning! Go to work and carry on, phone up give the note, or come clean and say I have been offered another job, but they would expect my notice there and then.

I already gave in my notice at the start of last week, I had intended to work it but they kept pushing and moving my location and putting me in these situations so I sent in my sick note Friday which will cover the rest of my notice but it also goes over my new start date which is where I'm concerned as I don't want to be signed off from my new job.

In your situation I would hand in your sick note now if it covers you until the new job and then hand in your notice when you only have the week left

OP you don't need to tell the new employer the note, or get the date changed.

@Sweetiexx it doesn't matter what your current employer expects. Give the note in, take your sick leave and submit your resignation when it suits you.

You can go back before if you feel well enough so that doesn't matter. Especially if you're changing jobs. We only tend to follow the GP advice for physical injuries as opposed to MH issues.

I hope your old employer has already done your reference though before you got signed off..............

Can the employer give you a bad reference if you take sick leave as your notice? They will be asking for mine this week.

I had already signed the contract at my new job before any of this happened as I did a day of training for them so my certificates were up to date for my first actual day and a partial shift to see if I liked the role.

So hopefully it won't affect me that way plus they are a local company so they know me, Dp his whole family ect and know its not like me but that's the supervisors not the owners.

Your employer isn't allowed to give a bad reference if its not fair or accurate
They can say you had x amount of time off or similar

I have no idea what insurance MIL thinks it could invalidate
maybe she's thinking more along the lines of me having a physical injury and not letting them know that I don't know maybe my arm is weak due to a break and it could cause an accident if I was asked to move heavy things

The MIL may be thinking of employer’s liability insurance. The potential issue is an employee who is signed off sick, but chooses to work, and then injures themselves at work.

An example is if someone was unwell and whilst at work they feinted and fell down the stairs badly injuring themselves. The employer would have to do a RIDDOR as it is an accident at work and the employee could make a claim for accident at work.
