My employment contract is unsigned - it has an old job title and salary - but I have the unsigned copy emailed to me from the CEO. Will this still be valid with regards to the notice period? Thank you.

I’m not a lawyer, but I believe once you’ve started work then you’ve implicitly agreed to the t & cs in the contract (it’s why you should never start work somewhere new until you’re happy with their contract). So I believe the notice period will be valid. Hopefully someone with a legal background will confirm this though!

I'm not sure if it has to be signed but if you have never been given an employment contract then you only have to give one week's notice.

But I have a feeling that if you have been given one even if not signed then it is still valid.

However, you are might be able to negotiate a reduction in your notice period, it's not unknown.

Agree with others - by not objecting to what you received, you accepted it by way of your conduct by continuing to work there.

Work have confirmed they don't have a signed copy on file.

I'm happy with the notice period - I would like to reduce it if possibly with annual leave accrued. I definitely don't want to have a longer notice period. I've been with the company over 10 years and was worried it could be 1 week per year worked if the contract was unsigned.

Your contractual notice period will apply. With your notice period you can ask to take accrued annual leave.

You can also talk to your employer and ask if they can release you early.

Ultimately an employer can’t force an employee to work their notice. They can sue for breach of contract but it is very rare for this to happen.

Thanks everyone. I am going to hand my notice in tomorrow. I am ridiculously excited! I will ask to take my accrued leave as part of my notice period. My new job would like me to start ASAP.

I'm just hoping my work is fair with me.
