Salary leak

Hey just wanted to check something before reacting.

Boss accidentally shared everyone’s monthly commission break down , it’s apparent there are huge discrepancies in what people are paid for the same type of work.

Is it illegal he shared this?

Am I within my rights to challenge and ask why some people are paid more ?

Oops.. i bet he is shitting himself.. It's not illegal to pay people different amounts for the same work.. however if there are structural inequalities, it might be...

If you believe that you are being paid less as discrimination, due to a 'protected characteristic' then you have every right to challenge it:

Protected characteristics are:

age.
disability.
gender reassignment.
marriage and civil partnership.
pregnancy and maternity.
race.
religion or belief.
sex.

Ooo and sexual orientation... that's also one!

Technically a data protection breach so he should report himself to the company DPO so they can investigate.

Whilst it is unfortunate and could lead to discontent, it's unlikely to result in any kind of fine from the ICO as it's small scale and genuine human error.

WhatATimeToBeAlive · 06/04/2022 11:30

Surely it's a breach of GDPR too.

AlisonDonut · 06/04/2022 11:31

Yes definitely not a good thing to have done but it might be good to break down what is going on and it is good evidence if you think people have a case for the pay gap discrimination.

I'd have been plugging the figures into an excel spreadsheet the moment I saw it to work out if it is something that needs to be addressed.

thisplaceisweird · 06/04/2022 11:35

I dont think it's illegal, no. But it is good leverage to ask for more money!

Jibbajabba1 · 06/04/2022 11:50

Wow I love mumsnet! Thank you everyone! It does seem the women in general are being paid less - will have to drill into the figures a bit more. Will start gathering my evidence - have been some other sexist type comments in meetings (not from this manager though)

You say it’s commission payments that are paid differently. Is that because male staff are working over time whereas female staff are going home to relieve childcare? I know it’s sexist but in my experience, it’s more often male colleagues that are able to put in the extra hours at work and women have to cover at home, which may be the reason why men are being paid more - because they’re doing more hours/more work

Jibbajabba1 · 06/04/2022 18:09

Yeah and that would make sense to a point. However the commission is result based rather than time based - and the results are all pretty on par. However, each individual is paid a different sum but for the same result.

Appreciate all the advice - I’ll try and think how to broach it with him, feel like I’ll get in trouble for noticing and mentioning :s
